In the case of Ana Ionescu and Others v. Romania,

Delivers the following judgment, which was adopted on that date:

PROCEDURE

1.  The case originated in nineteen applications against Romania lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”), mostly by Romanian nationals on the various dates indicated in the appended table.

2.  In a judgment delivered on 26 February 2019, the Court held that there had been a violation of Article 1 of Protocol No. 1 to the Convention on account of the applicants’ inability to recover possession of their properties despite final court decisions retroactively acknowledging their property rights. The Court also decided to award the applicants in application no. 36384/03 (Albu and Others v. Romania – see point 4 of the appended table), 43,200 euros (EUR) in respect of pecuniary damage and EUR 5,000 in respect of non-pecuniary damage and for costs and expenses, and dismissed the remainder of their claims for just satisfaction.

3.  On 30 September 2019 the Government informed the Court that on 21 August 2019 they had learned that Mr Petru Nicolae Albu had died on 1 November 2018. They accordingly requested revision of the judgment in accordance with Rule 80 of the Rules of Court.

4.  On 22 October 2019 the Court considered the request for revision and decided to give the applicants three weeks in which to submit any observations. Observations were received from Mr Albu’s heir, Ms Emma Albu, on 21 November 2019.

THE LAW

I. REQUEST FOR REVISION

5.  The Government requested revision of the judgment of 26 February 2019, which they had been unable to execute because Mr Petru Nicolae Albu had died before the judgment had been adopted.

6.  On 21 November 2019 Mrs Emma Albu submitted a certificate attesting to her status as the deceased applicant’s heir and a statement in which she expressed her wish to continue the proceedings in his stead. She asked to be granted the just satisfaction awarded by the Court in respect of her late husband, Mr Petru Nicolae Albu.

7.  The Court notes from the documents submitted to it that Mrs Emma Albu was the wife of the deceased applicant, Petru Nicolae Albu, and that she is his only heir.

8.  In the light of the foregoing, the Court considers that Mrs Emma Albu has standing to pursue the application in her deceased husband’s stead. It observes that she has expressed her intention to do so and requested that the judgment be revised.

9.  The Court considers that the judgment of 26 February 2019, as rectified on 13 June 2019, should be revised (see, for example, Wypukoł‑Piętka v. Poland (revision), no. 3441/02, 8 June 2010, Dzhabrailovy v. Russia (revision), no. 68860/10 and 4 others, 4 February 2016, and Cangöz and Others v. Turkey (revision), no. 7469/06, 19 September 2017), pursuant to Rule 80 of the Rules of Court, the relevant parts of which provide:

 “A party may, in the event of the discovery of a fact which might by its nature have a decisive influence and which, when a judgment was delivered, was unknown to the Court and could not reasonably have been known to that party, request the Court ... to revise that judgment.

...”

10.  The Court accordingly decides to award jointly the heir (Mrs Emma Albu) and the remaining applicants (Mrs Daniela Şandru, Mr Traian Petru Mihăilă and Mrs Ileana Viorica Oancea - see point 4 of the appended table) the amount it previously awarded to the applicants in application no. 36384/03, namely EUR 43,200 in respect of pecuniary damage and EUR 5,000 in respect of non-pecuniary damage and for costs and expenses (see paragraph 2 above).

11.  The Court considers it appropriate that the default interest rate should be based on the marginal lending rate of the European Central Bank, to which should be added three percentage points.

FOR THESE REASONS, THE COURT, UNANIMOUSLY,

1.      Decides to revise its judgment of 26 February 2019 insofar as it concerns the claims made under Article 41 of the Convention by the late applicant Mr Petru Nicolae Albu,

and accordingly,

2.      Holds

(a)   that the respondent State is to pay jointly Mrs Emma Albu and the remaining applicants in application no. 36384/03 (Mrs Daniela Şandru, Mr Traian Petru Mihăilă and Mrs Ileana Viorica Oancea), within three months from the date on which the judgment becomes final in accordance with Article 44 § 2 of the Convention, the amounts indicated in the appended table under point 4 in respect of pecuniary damage, non-pecuniary damage and costs and expenses, to be converted into the currency of the respondent State at the rate applicable at the date of settlement, plus any tax that may be chargeable;

(b)  that from the expiry of the above-mentioned three months until settlement, simple interest shall be payable on the above amounts at a rate equal to the marginal lending rate of the European Central Bank during the default period, plus three percentage points.
