APPLICATION pursuant to Articles 278 and 279 TFEU seeking the suspension of the operation of the European Food Safety Authority (EFSA) decision of 1 October 2018 on the assessment of the confidentiality claims made in relation to the application for renewal of the approval process for Ethoprophos as an active substance,
1 By letter lodged at the Court Registry on 3 June 2019, the applicant informed the Court that it wished to discontinue the proceedings for interim measures. The applicant requested that the parties be ordered to bear their own costs.
2 By letter lodged at the Court Registry on 19 June 2019, the defendant submitted observations on the withdrawal request in which it asked the Court, pursuant to Article 136(1) of the Rules of Procedure, to order the applicant to bear all the costs, including those incurred in the present proceedings for the adoption of interim measures. The intervener failed to submit observations on the discontinuance of the case.
3 By virtue of Article 158(5) of the Rules of Procedure, it is appropriate to reserve the costs.
4 The case shall therefore be removed from the register and the costs reserved.
On those grounds,
THE PRESIDENT OF THE GENERAL COURT
hereby orders:
1. Case T‑720/18 R is removed from the register of the General Court.
2. The costs are reserved.
