  1. We are not going to give our judgments today, we are going to write our judgments but we thought it might be helpful if we announced what the outcome is. We are going to allow the appeal, we are going to order a retrial and we are going to ask HHJ Hunt either to take the retrial or to allocate it to whoever he thinks appropriate.
