MR JUSTICE FRASER:
"[...] a prolonged, persistent and deliberate course of very bad driving AND/OR consumption of substantial amounts of alcohol or drugs leading to gross impairment [...]" will be determinants that place the case in level 1.
Here, in our judgment, the deliberate course of very bad driving puts this as a level 1 offence absent the drug use.
