MR JUSTICE MARCUS SMITH:
"It is averred by the claimant/respondent that the skeleton argument in support of ground 2 of the appeal goes beyond the remit of an appeal and is again an attempt to seek to relitigate the findings of fact made by HHJ Gerald. The appeal court should be aware that there were a number of factors affecting the judge's calculation of the value of the shares. It is averred that the appellant seeks to place entire weight on one aspect of a calculation of the shares of Mr Ansell. There were a number of factors HHJ Gerald carefully considered, including potential offers in excess of the sum calculated by HHJ Gerald."
