Ian David Spires v (1) Richard John Stanley (2) Haversham-cum-Little Linford Parish Council (Easements and profits a prendre : Prescription, requirements and acquisition) [2018] UKFTT 75 (PC) (15 January 2018)
Application in FR1 to first registration of a former sewage treatment works. Applicant also claimed a prescriptive right of way to the subject land. There were no objections to the title application, but 2 objections to the claimed easement (the alleged servient land was in separate ownership). HELD that the application failed. There was insufficient evidence to support the claim to a prescriptive easement.
