Attorney General v. Jakub Sebastian Piotrowski (Unreported, High Court, Edwards J., 21st October, 2014) Extradition - European Convention on Extradition 1957 - Extradition Act 1965 -Refusal to surrender - Respondent charged with importation and sale of drugs/psychotropic substances as part of an organised criminal group contrary to article 307 and article 27 of the Criminal Code of Ukraine - Requirements for request for extradition were fulfilled - Requirements of correspondence and minimum gravity were met - Points of objection; article 3, 6 and 8 of the European Convention on Human Rights - Country of Origin Information; substandard prison conditions, serious ill treatment of prisoners, treatment amounting potentially to torture, inhuman or degrading treatment or punishment - article 3 objection upheld ;“real risk that the respondent’s rights under article 3 of the European Convention of Human Rights will be breached” - Dismissal of article 6 and 8 objection - Refusal of committal order under s. 29 of the Act of 1965 - Discharge of the respondent ordered.
