Ryanair Ltd -v- On The Beach Ltd (Approved) [2022] IEHC 385 (23 June 2022)
"The plaintiff was guilty of inordinate delay where it had taken no step whatsoever in the proceedings for a period of over three years and this delay was not excusable as it seemed to be as a result of a decision by the plaintiff to "park" the proceedings while pursuing similar claims against third parties. However, the balance of justice did not favour dismissal as the defendant had not established prejudice arising from the existence of the proceedings and the proceedings could be fairly tried."
