UNEMPLOYMENT INSURANCE (INSURANCE INDUSTRY SPECIAL SCHEME) APPORTIONMENT OF GRANT ORDER, 1923.

ORDER MADE BY THE MINISTER FOR FINANCE.

ORDER MADE BY THE MINISTER FOR FINANCE.

WHEREAS by section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922) it is enacted that wherever under any British Statute any grant, whether annual or capital, is directed to be made by the Treasury out of the Consolidated Fund or by the Treasury or any other Government Department out of any other fund, and the amount of such grant is by such statute fixed either for the whole of the United Kingdom or for any part thereof which included the area now comprised in Saorstát Éireann, the Minister for Finance may by order apportion such amount between Saorstát Eireann and the rest of the area in respect of which such amount is fixed as aforesaid and may by such order fix the amount of such grant to be made under such statute in Saorstát Éireann :

AND WHEREAS by sub-section (7) of section 18 of the British Statute entitled the Unemployment Insurance Act, 1920 (10 & 11 Geo. V. ch. 30) (hereinafter called the Act) it is enacted that where a special scheme under the Act is in force, there shall, subject to compliance with the prescribed conditions be paid to the body charged with the administration of the scheme in every year out of moneys provided by Parliament such sum as the Minister for Labour, in view of the estimated income and expenditure under the scheme, may by regulations made by him with the consent of the Treasury determine but not exceeding in any event three-tenths of the amount, calculated in the prescribed manner, which would, if the scheme had not been in force, have been paid by way of contributions under the general provisions of the Act out of moneys provided by Parliament in respect of the employed persons to whom the scheme applies.

AND WHEREAS the Insurance Industry Unemployment Insurance Scheme (hereinafter called the Scheme) duly came into force previous to and was in force on the 6th day of December, 1921 as a Special Scheme under Section 18 of the Act for the Insurance Industry.

AND WHEREAS the Scheme was by virtue of the provisions therein contained administered by a Joint Board of Management (hereinafter called the Joint Board).

AND WHEREAS Regulations entitled the Unemployment Insurance (Insurance Industry Special Scheme) (Grant) Regulations, 1923 were duly made pursuant to the said sub-section (7) of section 18 of the Act and it is by such Regulations ordered that while the Scheme is in force the sum to be paid under the said sub-section (7) of section 18 of the Act out of moneys provided by Parliament to the Joint Board shall in every insurance year be whichever of the two following amounts is in that insurance year the less that is to say :--

(a) An amount equal to one-fourth of the amount received by the Joint Board by way of contributions in respect of employed persons properly paid during the insurance year in question under the provisions of the Scheme ; or,

(b) an amount equal to three-tenths of the amount which would, if the Scheme had not been in force and if the rates of contribution set out in the Third Schedule to the Act as originally enacted had been in operation, have been paid by way of contributions under the general provisions of the Act out of moneys provided by Parliament in respect of the employed persons to whom the Scheme applies.

AND WHEREAS the sum fixed by the joint operation of the said sub-section (7) of section 18 of the Act and the Regulations aforesaid was fixed for the whole of the late United Kingdom, which included the area now comprised in Saorstát Éireann, and it is necessary that such sum should be apportioned between Saorstát Éireann and the rest of the area in respect of which the said sum was fixed as aforesaid and that the annual sum to be paid in Saorstát Éireann under the joint operation of the said sub-section and the Regulations should be fixed.

NOW, I, EARNÁN DE BLAGHD, Minister for Finance in Saorstát Eireann, in exercise and by virtue of the power in this behalf vested in the Minister for Finance by the Adaptation of Enactments Act, 1922 (No. 2 of 1922) and of every and any other power me in this behalf enabling do hereby order as follows :--

1. In this Order

the expression " the Act " means the Unemployment Insurance Act, 1920 (10 & 11 Geo. V. ch. 30), the expression " the Scheme " means the Insurance Industry Unemployment Insurance Scheme hereinbefore referred to, the expression " the Joint Board " means the Joint Board of Management by which the Scheme is administered as hereinbefore recited, the expression " the Regulations " means the Unemployment Insurance (Insurance Industry Special Scheme) (Grant) Regulations hereinbefore recited.

2. The sum payable under sub-section (7) of section 18 of the Act while the Scheme is in force shall be apportioned between Saorstát Éireann and the rest of the area in respect of which the said sum was fixed as hereinbefore recited in proportion to the amounts paid by way of such contributions as are mentioned in the Regulations in Saorstát Éireann and the rest of the area aforesaid respectively.

3. The annual sum to be paid in Saorstát Eireann under the said sub-section (7) of section 18 of the Act while the Scheme is in force in Saorstát Eireann to the Board for the time being exercising in Saorstát Eireann the functions of the Joint Board under the Scheme shall in every insurance year be whichever of the two following amounts is in that insurance year the less, that is to say :--

(a) An amount equal to one-fourth of the amount received by the Board for the time being exercising in Saorstát Eireann the functions of the Joint Board under the Scheme by way of contributions in respect of employed persons properly paid during the insurance year in question under the provisions of the Scheme ; or

(b) an amount equal to three-tenths of the amount which would, if the Scheme had not been in force and if the rates of contribution set out in the Third Schedule to the Act as originally enacted had been in operation, have been paid by way of contributions in Saorstát Éireann under the general provisions of the Act out of moneys provided pursuant thereto in respect of the employed persons to whom the Scheme applies.

4. Nothing in this Order shall affect the powers of the Minister for Industry and Commerce to revoke vary, or amend the provisions of the Scheme under section 18 of the Act or section 10 of the Unemployment Insurance Act, 1923 (No. 17 of 1923), or any other powers enabling him in that behalf.

5. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

6. This Order may for all purposes be cited as the Unemployment Insurance (Insurance Industry Special Scheme) Apportionment of Grant Order, 1923.
