CLOSING OF ROADS (PUBLIC NOTICE) REGULATIONS 1925.

WHEREAS by Section 29 of the Local Government Act, 1925 , (hereinafter referred to as " the Act ") it is enacted in effect that on the application of the Council charged with the maintenance of any road the Minister may by order made after giving such public notice as may be prescribed in that behalf by regulations made under the Act, and after holding such local inquiry as he shall think necessary, authorise such council to close such road or any particular portion thereof to public traffic for such period and subject to such conditions as the Minister shall think proper and shall specify in the Order :—

AND WHEREAS by Section 1 of the Act, it is enacted that unless the context otherwise requires, the expression " the Minister " means the Minister for Local Government and Public Health and the expression " prescribed " means prescribed by the Minister :

NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the powers vested in me by the said recited section, do by this my Order prescribe the following regulations with respect to the giving of public notice for the purposes of the said section, that is to say :—

1. These regulations may be cited as the Closing of Roads (Public Notice) Regulations, 1925.

2. In these regulations, the expression—

(1) " the Council " means the council charged with the maintenance of any road ;

(2) " the Minister " means the Minister for Local Government and Public Health ;

(3) " road " includes portion of a road.

3. The Minister may, in any case where it is expedient that a road should be closed forthwith to public traffic, assent to such departures from and modifications to the provisions of these regulations as he may deem necessary.
