RIVER ILEN


I, FIONÁN O LOÍNGSIGH, Minister for Lands and Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1) It is prohibited to use any net for the purpose of taking or with intent to take fish in any part of the River Ilen and its tributaries above the Bridge known as the Abbey Bridge or New Bridge, between the Townlands of Abbeystrowry and Coronea in the Parish of Abbeystrowry and County of Cork, save landing nets used solely as auxiliary to fishing legally with rod and line and save nets used legally for the capture of eels.

(2) It is prohibited to put, leave or have in possession in or on the banks of the said part of the River Ilen any net, mounted and capable of being used for fishing, of which the use would not be lawful at the time.

(3) The By-Law dated the 13th day of May, 1908, relating to the use of nets in the said River Ilen is hereby revoked.

(4) Each and every person offending against this By-Law shall forfeit and pay for each offence a sum not exceeding five pounds ; and every net used or found contrary to this By-Law shall be forfeited.

(5) The Interpretation Act, 1923 , (No. 46 of 1923), applies to the interpretation of this By-Law in like manner as it applies to the interpretation of an Act of the Oireachtas.

(6) This By-Law may be cited for all purposes as the River Ilen By-Law, No. 395, 1929.

Note.—Under the provisions of the Fisheries Act, 1925 , this By-Law will come into operation on the twenty-eighth day after the above date.
