THE LOCAL OFFICES AND EMPLOYMENTS (GAELTACHT) (AMENDMENT) ORDER, 1932. | ||
DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH. | ||
WHEREAS in pursuance of Section 15 of the Local Government (Temporary Provisions) Act, 1923 , the Minister for Local Government and Public Health did, by the Local Offices and Employments (Gaeltacht) Order, 1928, as amended by the Local Offices and Employments (Gaeltacht) Order, 1931, make and prescribe rules and regulations with respect to the continuance of persons in the offices or employments set forth in the First Schedule to the first-mentioned Order where the duties of such offices or employments are to be performed in or in relation to the Gaeltacht as defined in the said Order or any part thereof: | ||
AND WHEREAS it is expedient to amend the said Orders in manner hereinafter appearing: | ||
NOW THEREFORE, the Minister for Local Government and Public Health, in exercise of the powers vested in him by Section 15 of the Local Government (Temporary Provisions) Act, 1923 , does by this his Order, order and direct as follows, that is to say:— | ||
1.—(1) This Order may be cited as the Local Offices and Employments (Gaeltacht) (Amendment) Order, 1932. | ||
(2) This Order shall be read and construed as one with the Local Offices and Employments (Gaeltacht) Orders, 1928 and 1931 and may be cited collectively with those Orders as the Local Offices and Employments (Gaeltacht) Orders, 1928 to 1932. | ||
2. In this Order:— | ||
(i) the word "Minister" means the Minister for Local Government and Public Health; | ||
(ii) the expression "the Principal Order" means the Local Offices and Employments (Gaeltacht) Order, 1928; | ||
(iii) the expression "the Order of 1931" means the Local Offices and Employments (Gaeltacht) Order, 1931. | ||
3.—Article 3 of the Principal Order, as amended by Article 2 of the Order of 1931, shall in its application to a person holding an office or employment under a local authority at the date of this Order have effect as if for the period of three years therein mentioned there were substituted a period of four years. | ||
4.—Notwithstanding anything contained in the Principal Order as amended by the Order of 1931, and this Order where any person is about to cease to hold any office or employment by reason of his or her failure to satisfy the Minister as to his or her knowledge of the Irish language as required by the Principal Order within the period limited by the said Orders, the Minister may from time to time extend the period for which such person may continue in such office or employment to such time as the Minister shall think proper, in any case in which the Minister is satisfied— | ||
(a) that such failure is attributable to illness, accident or other circumstance beyond the control of such person; or | ||
(b) that by reason of the nature of the duties of the office or employment held by such person, it is expedient in the interests of the local authority in whose service such person is that such person should be continued in the office or employment for a further period. | ||
5.—Article 3 of the Principal Order shall in its application to any person appointed to an office or employment on or after the date of this Order have effect as if for the words "who was not immediately before such appointment in the service of the local authority there were substituted the words "who was not immediately before such appointment and has not been continuously from a date prior to the date of this Order in the service of the local authority in a permanent capacity." | ||
