THE RAILWAYS (MODIFICATION OF SERVICE) (BALTINGLASS AND TULLOW LINE) ORDER, 1932. | ||
THE RAILWAYS (MODIFICATION OF SERVICE) (BALTINGLASS AND TULLOW LINE) ORDER, 1932, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE PURSUANT TO SECTION 7 of THE RAILWAYS (MISCELLANEOUS) ACT, 1932 . | ||
WHEREAS it is enacted by Section 7 of the Railways (Miscellaneous) Act, 1932 , that the Minister for Industry and Commerce may, by order made on the application of a company owning a railway line to which Part II of the said Act applies, relieve such company from any obligation imposed on such company by or under that Act of running a particular service of trains over such railway line and, in lieu thereof, shall by such order impose on such company the obligation of running over such railway line the modified service of trains specified in such order : | ||
AND WHEREAS Part II of the said Act applies to the railway line between Baltinglass and Tullow : | ||
AND WHEREAS the Great Southern Railways Company, being the owner of the said railway line, has applied to the Minister for Industry and Commerce for an order under Section 7 of the said Act in respect of the said railway line : | ||
AND WHEREAS the Minister for Industry and Commerce is satisfied that having regard to the alternative transport facilities which are or will be available in the district served by the said railway line no undue inconvenience will be occasioned by this order to the public in such district : | ||
NOW, THEREFORE, the Minister for Industry and Commerce in the exercise of the powers conferred on him by the Railways (Miscellaneous) Act, 1932 , and of all other powers him in this behalf enabling does hereby order :— | ||
1. The Great Southern Railways Company is hereby relieved from the obligation imposed upon it by or under Section 6 of the said Act in respect of the running of trains over the railway line between Baltinglass and Tullow, and in lieu thereof it shall be obligatory for the Company to run over such line the following modified service of trains— | ||
a train for the carriage of passengers each way every morning on week-days ; | ||
a train for the carriage of passengers each way every evening on week-days ; | ||
a train for the carriage of merchandise each way daily on week-days. | ||
Provided that whenever the quantity of merchandise for transit is such that it can be carried by running the merchandise wagons with a passenger train, in accordance with the law in force for the time being for the operation of mixed trains for the conveyance of passengers and merchandise, and that such arrangement will not cause undue inconvenience or delay to passengers, it shall not be obligatory on the Company to provide a separate train for merchandise. | ||
2. This Order shall come into operation on the seventh day of October, 1932. | ||
3. This Order may be cited for all purposes as the Railways (Modification of Service) (Baltinglass and Tullow Line) Order, 1932. | ||
