TRANSIT OF ANIMALS ORDER, 1933.

ORDER OF THE MINISTER FOR AGRICULTURE.

(Dated 7th April, 1933.)

The Minister for Agriculture, by virtue and in exercise of the powers vested in him by the joint operation of the Agriculture Act, 1931 (No. 8 of 1931), and of the Diseases of Animals Acts, 1894 to 1932, and of every and any other power him in this behalf enabling, hereby orders as follows :—

1. This Order may be cited for all purposes as the Transit of Animals Order, 1933, and shall be construed as one with the Transit of Animals Order of 1927.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

Amendment of Article 23 of the Transit of Animals Order of 1927.

3. Article 23 of the Transit of Animals Order of 1927 shall be construed and have effect as if there were inserted at the end of the said Article a new paragraph as follows :—

"(5) Where a vessel subsequent to the cleansing and disinfection required by the foregoing paragraphs of this Article is used for the carrying of cargo other than animals, the vessel shall, before the taking on board of any animal, be cleansed as follows:—

(i) All hay, straw and other packing material and all chemicals or other agents or things likely to cause injury to animals, shall be effectually removed from all parts of the vessel with which any animal may come in contact.

(ii) The hay, straw or other packing material as aforesaid shall not be landed unless and until it has been well mixed with quicklime. Such material shall, if landed, be forthwith effectually removed from contact with animals, or be destroyed by fire. If not landed, such material shall be destroyed by fire in the ship's furnace, or by other effective means.

(iii) The parts of the vessel from which the hay, straw or other packing material, or the chemicals or other agents or things as aforesaid, have been removed, shall then be thoroughly swept and cleansed or swilled out."

Obligation on Masters of vessels.

4. It shall not be lawful for the Master of a vessel to receive into such vessel any animals intended to be exported, in case such vessel at any time within the period of twenty-eight days next preceding such reception has had on board any animal which had been exported or carried coastwise from any port or place in any country, other than Saorstát Eireann, Great Britain, Northern Ireland, the Channel Islands or the Isle of Man, or has entered or been within any such port or place, unless such vessel has before such reception been first effectively cleansed and disinfected to the satisfaction of a Veterinary Inspector of the Minister for Agriculture and the said Veterinary Inspector has issued to the said Master in respect of such vessel a certificate in the Form set out in the Schedule to this Order or to the like effect.

Saving for Exportation of Animals (Irish Free State) Order of 1923.

5. Nothing in this Order shall be construed as in any way affecting the operation of the Exportation of Animals (Irish Free State) Order of 1923.

Revocation.

6. The Transit of Animals Order of 1927, Amendment Order, 1930, is hereby revoked.
