No. 231/1934:

CONTROL OF IMPORTS (QUOTA No. 2) ORDER, 1934.

CONTROL OF IMPORTS (QUOTA No. 2) ORDER, 1934.

WHEREAS it is enacted by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order (in that Act called a quota order) prohibit, subject to the provisions of the said Act, the importation into Saorstát Eireann on or after a specified day (in that Act referred to as the commencement of such order) not prior to the date of such order of any particular description or descriptions of goods and that the Executive Council shall, in and by every quota order, appoint the day (not more than six weeks after the commencement of such order) on which the first quota period under such quota order shall commence :

NOW, the Executive Council, in exercise of the powers conferred on them by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited for all purposes as the Control of Imports (Quota No. 2) Order, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this order—

the expression " the Act " means the Control of Imports Act, 1934 (No. 12 of 1934) ;

references to pneumatic tyres shall be construed as including partially manufactured pneumatic tyres and also pneumatic tyres which have been used as tyres or for any other purpose.

4. For the purposes of this Order the outer cover of a pneumatic tyre shall be deemed to be a pneumatic tyre, and the inner tube of a pneumatic tyre shall also be deemed to be a pneumatic tyre, and the expression " pneumatic tyre " shall, in this Order, be construed accordingly.

5. Subject to the exceptions and qualifications mentioned in the next following paragraph of this Order, the importation into Saorstát Eireann on or after the 1st day of September, 1934, of pneumatic tyres of any of the descriptions specified in the Schedule hereto is hereby prohibited.

6. The prohibition effected by the next preceding paragraph of this Order shall not extend or apply to any pneumatic tyre which :—

(a) is, in the opinion of the Revenue Commissioners, primarily intended for use on a mechanically propelled vehicle which is not either a bicycle or a tricycle, or

(b) is imported together with a bicycle, tricycle or other vehicle or the chassis of a vehicle as part of the equipment of such vehicle or chassis and, in the opinion of the Revenue Commissioners, forms part of the normal equipment of such vehicle or chassis, or

(c) is imported under and in accordance with a licence in that behalf issued under the Act, or

(d) is an article to which this Order is precluded by sub-section (4) of Section 3 of the Act from applying.

7. The 1st day of October, 1934, is hereby appointed to be the day on which the first quota period under this Order shall commence.

SCHEDULE.

1. Pneumatic tyres which, in the opinion of the Revenue Commissioners, are designed, constructed, and intended for use on mechanically propelled bicycles or tricycles and on which any of the following sizes is stamped, marked, or otherwise indicated (whether by the appropriate words and figures in the following list of sizes or by words, figures, and signs or any of them to the like effect) as the size of the tyre, that is to say :—

3·50 inches X 19 inches
4·00  " X 19  "

2. Pneumatic tyres which, in the opinion of the Revenue Commissioners, are designed, constructed, and intended for use on bicycles or tricycles normally propelled otherwise than by mechanical means and on which any of the following sizes is stamped, marked, or otherwise indicated (whether by the appropriate words and figures in the following list of sizes or by words, figures, and signs or any of them to the like effect) as the size of the tyre, that is to say :—

26 inches X inches
26 " X 13/8 "
26 " X "
28 " X "

3. Pneumatic tyres which, in the opinion of the Revenue Commissioners, are designed, constructed, and intended for use on mechanically propelled bicycles or tricycles or for use on bicycles or tricycles normally propelled otherwise than by mechanical means and on which (in either case) the size of the tyre is not stamped, marked, or otherwise indicated.
