CÓMHLUCHT SIÚICRE EIREANN, TEORANTA (BALANCE SHEET) REGULATIONS, 1934.

CÓMHLUCHT SIÚICRE EIREANN, TEORANTA (BALANCE SHEET) REGULATIONS, 1934.

WHEREAS it is enacted by sub-section (1) of section 15 of the Sugar Manufacture Act, 1933 (No. 31 of 1933), that Cómhlucht Siúicre Eireann, Teoranta (in that Act and hereinafter referred to as the Company) shall within ninety days after the end of every accounting year furnish to the Minister for Finance a balance sheet for such accounting year duly audited by the auditor of the Company and also a profit and loss account for the same accounting year similarly audited :

AND WHEREAS it is enacted by sub-section (2) of the said section 15 that the balance sheet and profit and loss account to be furnished under the said sub-section (1) shall be drawn up in such manner as shall be prescribed by regulations made under the said section 15, and that such balance sheet shall contain (in addition to any matter required by such regulations) a summary of the capital, assets and liabilities of the Company together with such particulars as will disclose the nature of such assets and liabilities and the manner in which the value of the assets was arrived at :

AND WHEREAS it is enacted by sub-section (6) of the said section 15 that the Minister for Finance may by Order make regulations prescribing any matter referred to in the said section as prescribed by regulations made under the said section :

NOW, the Minister for Finance, in exercise of the powers conferred on him by sub-section (6) of section 15 of the Sugar Manufacture Act, 1933 (No. 31 of 1933), and of every and any other power him in that behalf enabling, hereby makes the following regulations, that is to say :—

1. These Regulations may be cited for all purposes as Cómhlucht Siúicre Eireann, Teoranta (Balance Sheet) Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations—

the expression " the Act " means the Sugar Manufacture Act, 1933 (No. 31 of 1933);

the expression " the Company " means Cómhlucht Siúicre Eireann, Teoranta.

4. The balance sheet of the Company to be furnished by the Company to the Minister for Finance in pursuance of sub-section (1) of section 15 of the act shall be drawn up in the manner in which the balance sheet of a company registered under the Companies Acts, 1908 to 1924, is required by law to be drawn up, and such balance sheet shall contain a summary of the capital, assets and liabilities of the Company together with such particulars as will disclose the nature of such assets and liabilities and the manner in which the value of such assets was arrived at.

5. The profit and loss account of the Company to be furnished by the Company to the Minister for Finance in pursuance of sub-section (1) of section 15 of the act shall be drawn up in such manner that the following particulars shall be shown, that is to say—

(a) the balance shown on the previous year's profit and loss account and the manner of dealing with such balance, and

(b) the profit or loss (as the case may be) arrived at after charging all manufacturing and establishment expenses for the year to which such account relates, and

(c) all charges for interest, depreciation, appropriations (including directors' fees) and other made before arriving at the net profit or the net loss (as the case may be).
