No. 322/1934:

HOME-GROWN BARLEY (MINIMUM PRICES) ORDER, 1934.

WHEREAS by virtue of the Agricultural Produce (Cereals) Act, 1934 (Operation of Part IV) Order, 1934 (Statutory Rules and Orders No. 273 of 1934). Part IV of the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), came into operation on the ninth day of October, 1934;

AND WHEREAS it is enacted by sub-section (1) of section 56 (being a section contained in the said Part IV) of the said Act that the Minister for Agriculture may, whenever and so often as he thinks fit, by order under the said sub-section do the following things, that is to say:—

(a) divide, by reference to bushel weights, home-grown barley into such and so many classes as he thinks proper, and

(b) fix, in respect of each class of home-grown barley, the minimum price, in terms of a rate per hundredweight and on the basis that such barley is to be delivered carriage paid at the premises of the purchaser, to be paid by registered oat and barley dealers therefor,

(c) prohibit the sale to or purchase by registered oat and barley dealers of home-grown barley of a particular class at a price less than the price fixed by such order for home-grown barley of that class.

NOW, THEREFORE, I, Seámas O Riain, Minister for Agriculture, in exercise of the powers conferred on me by sub-section (1) of section 56 of the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say:—

1. (1) This Order may be cited for all purposes as the Home-grown Barley (Minimum Prices) Order, 1934.

(2) This Order shall come into force on the 1st day of November, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. For the purposes of this Order, home-grown barley is hereby divided into the nine classes specified in the second column of the Schedule hereto, and the minimum price per hundredweight to be paid by registered oat and barley dealers for home-grown barley of a particular class shall be the sum set out in the third column of the said Schedule opposite the mention of home-grown barley of that class in the said second column.

4. The sale to or purchase by registered oat and barley dealers of home-grown barley of a particular class at a price less than the price fixed by this Order for home-grown barley of that class is hereby prohibited.
