THE TOBACCO ACT (MANUFACTURERS' RETURNS REGULATIONS) ORDER, 1934, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 16TH DAY OF NOVEMBER, 1934, PURSUANT TO SUB-SECTION (2) OF SECTION 9 of THE TOBACCO ACT, 1934 .

WHEREAS it is enacted by sub-section (2) of section 9 of the Tobacco Act, 1934 , that the Minister for Industry and Commerce may by Order make Regulations in relation to any matter or thing referred to in the said Act as prescribed by the said Minister:

AND WHEREAS it is enacted by sub-section (1) of section 39 of the said Act that every manufacturer shall, not later than such date as may be prescribed by the Minister for Industry and Commerce in relation to the year 1934 and not later than the 1st day of September in the year 1935 and every subsequent year, send to that Minister a return in the form prescribed by that Minister, showing the quantities, types and classes of tobacco used by him for manufacturing purposes during the period of twelve months ending on the 5th day of July in such year and the quantities and classes of manufactured tobacco produced therefrom.

NOW, THEREFORE, the Minister for Industry and Commerce, in exercise of the powers conferred on him by sub-section (2) of section 9 of the Tobacco Act, 1934 , and of every and any other power him in this behalf enabling hereby orders as follows, that is to say :—

1. This order may be cited for all purposes as the Tobacco Act (Manufacturers' Returns Regulations) Order, 1934.

2. The Interpretation Act, 1923 , applies to the interpretation of this order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The following regulations shall have effect for the purposes of sub-section (1) of section 39 of the Tobacco Act, 1934 , that is to say :—

1. The date not later than which, in relation to the year 1934, every manufacturer shall send to the Minister for Industry and Commerce the return mentioned in sub-section (1) of section 39 of the Tobacco Act, 1934 , shall be the 1st day of December, 1934.

2. The form in which every manufacturer shall send to the Minister for Industry and Commerce the return mentioned in sub-section (1) of section 39 of the Tobacco Act, 1934 , shall be the form set out in the Schedule to this Order.
