CATTLE (MINIMUM PRICE AND CALCULATION OF PRICE) REGULATIONS, 1934.

CATTLE (MINIMUM PRICE AND CALCULATION OF PRICE) REGULATIONS, 1934.

WHEREAS it is enacted by sub-section (1) of Section 25 of the Slaughter of Cattle and Sheep Act, 1934 , (No. 42 of 1934), that the Minister for Agriculture may by order make regulations for all or any of the purposes mentioned in the said sub-section and, amongst others, for the purpose of fixing the minimum price at which cattle may be bought by a registered proprietor of registered premises, including the fixing of different such minimum prices for different grades of cattle and for different areas or districts and also for the purpose of fixing the basis, whether by weight, by hand, or otherwise, on which the price of cattle is to be calculated on any sale or on any agreement or contract for the sale of cattle for slaughter, including the fixing of different such bases for different grades of cattle and for different areas or districts:

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by Section 25 of the Slaughter of Cattle and Sheep Act, 1934 , (No. 42 of 1934), and of every and any other power me in this behalf enabling do hereby order and make the following regulations, that is to say:—

1. These Regulations may be cited as the Cattle (Minimum Price and Calculation of Price) Regulations, 1934.

2. The Interpretation Act, 1923 , (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The minimum price at which bullocks and heifers aged six months or more may be bought by a registered proprietor of registered premises shall be twenty-five shillings the hundredweight.

4. —(1) The basis on which the price of bullocks and heifers aged six months or more is to be calculated on any sale or on any agreement or contract for the sale of such bullocks and heifers for slaughter shall be by live weight.

(2) In this paragraph, the expression "live weight"—

(a) in relation to an animal the sale or agreement or contract for the sale of which is made at a toll fair at which a weighing machine for cattle is provided in pursuance of the Markets and Fairs (Weighing of Cattle) Acts, 1887 and 1891, means the weight of such animal as ascertained by actual weighing while alive on such weighing machine, and

(b) in relation to an animal the sale or agreement or contract for the sale of which is made at a place at which a public weighing machine for cattle is provided by the local authority, means the weight of such animal as ascertained by actual weighing while alive on such weighing machine, and

(c) in relation to an animal the sale or agreement or contract for the sale of which is made at any other place, means the weight of such animal as ascertained by actual weighing while alive on a weighing machine agreed upon by the seller and the buyer of such animal or, in default of such agreement, the estimated live weight of such animal.

5. This Order shall not apply in relation to the purchase by a person carrying on a business under a manufacturing licence of an animal which is purchased by such person for use in such business.
