UNEMPLOYMENT ASSISTANCE (APPLICATION FOR ASSISTANCE REGULATIONS) ORDER, 1935. | ||||||||||||||||||||||
THE UNEMPLOYMENT ASSISTANCE (APPLICATION FOR ASSISTANCE REGULATIONS) ORDER, 1935, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 28TH DAY OF MARCH, 1935, PURSUANT TO SECTION 7 of THE UNEMPLOYMENT ASSISTANCE ACT, 1933 . | ||||||||||||||||||||||
WHEREAS it is enacted by sub-section (1) of Section 7 of the Unemployment Assistance Act, 1933 , that the Minister for Industry and Commerce may by order make regulations prescribing any matter or thing which is referred to in the said Act as prescribed or to be prescribed : | ||||||||||||||||||||||
NOW THEREFORE the Minister for Industry and Commerce in exercise of the powers conferred on him by sub-section (1) of Section 7 of the Unemployment Assistance Act, 1933 , and of every and any other power him in this behalf enabling, hereby orders as follows, that is to say— | ||||||||||||||||||||||
1. This Order may be cited for all purposes as the Unemployment Assistance (Application for Assistance Regulations) Order, 1935. | ||||||||||||||||||||||
2. The Interpretation Act, 1923 , applies to the interpretation of this order in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||||||||||||||||||||||
3. The following regulations shall have effect for the purposes of the Unemployment Assistance Act, 1933 , that is to say— | ||||||||||||||||||||||
I. In these regulations— | ||||||||||||||||||||||
the expression " the Minister " means the Minister for Industry and Commerce ; | ||||||||||||||||||||||
the expression " applicant " means the holder of a qualification certificate who has duly made an application for unemployment assistance. | ||||||||||||||||||||||
II. For the purposes of the Unemployment Assistance (Employment Periods) Order, 1935, an applicant who resides outside the boundary of any county or other borough or of any urban district or of any town having commissioners under the Towns Improvement Act, 1854, shall satisfy an unemployment assistance officer that he complies with the statutory conditions for receiving unemployment assistance in the manner prescribed by regulation V of the regulations made by the Unemployment Assistance (Application for Assistance Regulations) Order, 1934, and in addition in the following manner, that is to say— | ||||||||||||||||||||||
(a) by delivering (if required so to do by the Minister) the form set out in the schedule to this order, duly completed, at a duly authorised Employment Exchange or Branch Employment Office or other place appointed by the Minister, and | ||||||||||||||||||||||
(b) if he is the occupier of land entered as such in the valuation list within the meaning of the Valuation Acts, by furnishing (if required so to do by the Minister) a recent demand note for rates served upon such occupier, or a certificate of valuation of the land occupied by such occupier, or by furnishing such other evidence as the Minister may require. | ||||||||||||||||||||||
III. For the purpose of these regulations a person who lets land for depasturage for a period of less than one year shall be deemed to be the occupier of the land so let. | ||||||||||||||||||||||
