CONTROL OF IMPORTS (QUOTA No. 19) ORDER, 1935.

CONTROL OF IMPORTS (QUOTA No. 19) ORDER, 1935.

WHEREAS it is enacted by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order (in that Act called a quota order) prohibit, subject to the provisions of the said Act, the importation into Saorstát Éireann on or after a specified day (in that Act referred to as the commencement of such order) not prior to the date of such order of any particular description or descriptions of goods, and that the Executive Council shall, in and by every quota order, appoint the day (not more than six weeks after the commencement of such order) on which the first quota period under such quota order shall commence :

NOW, the Executive Council, in exercise of the powers conferred on them by Section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quota No. 19) Order, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order—

the expression " the Act " means the Control of Imports Act, 1934 (No. 12 of 1934) ;

the expression " mechanically propelled vehicle " includes a vehicle which is, in the opinion of the Revenue Commissioners, designed, constructed, and intended to be drawn by a mechanically propelled vehicle ;

the expression " outer cover " means the outer cover of a pneumatic tyre and shall be construed as including a partially manufactured outer cover and an outer cover which has been used whether as part of a tyre or for any other purpose.

4. Subject to the exceptions and qualifications mentioned in the next following paragraph of this Order, the importation into Saorstát Éireann on or after the 1st day of July, 1935, of outer covers of any of the descriptions specified in the Schedule hereto is hereby prohibited.

5. The prohibition effected by the next preceding paragraph of this Order shall not extend or apply to any outer cover which—

(a) is, in the opinion of the Revenue Commissioners, primarily intended for use on a mechanically propelled bicycle or tricycle, or

(b) is imported together with a vehicle or the chassis of a vehicle as part of the equipment of such vehicle or chassis and, in the opinion of the Revenue Commissioners, forms part of the normal equipment of such vehicle or chassis, or

(c) is imported under and in accordance with a licence in that behalf issued under the Act, or

(d) is an article to which this Order is precluded by sub-section (4) of Section 3 of the Act from applying.

6. The 1st day of August, 1935, is hereby appointed to be the day on which the first quota period under this Order shall commence.

Outer covers which are, in the opinion of the Revenue Commissioners, designed, constructed, and intended for use on mechanically propelled vehicles other than bicycles or tricycles and on which any of the following sizes is stamped, marked or otherwise indicated (whether by the appropriate words and figures in the following list of sizes or by words, figures, and signs or any of them to the like effect) as the size of the cover, that is to say :—

4·50 inches X 17 inches.
