BREAD (PRICE) (No. 1) ORDER, 1936.

THE BREAD (PRICE) (No. 1) ORDER, 1936, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 2ND DAY OF NOVEMBER, 1936, PURSUANT TO THE BREAD (REGULATION OF PRICES) ACT, 1936 .

WHEREAS it is enacted by sub-section (1) of Section 3 of the Bread (Regulation of Prices) Act, 1936 , that the Minister for Industry and Commerce may, whenever and so often as he thinks fit, by order fix the maximum price at which bread of a specified kind (defined in such manner and by reference to such things as the Minister shall think proper) may be sold or offered for sale in a specified area when sold or offered for sale under such one or more of the sets of conditions mentioned in the said sub-section as shall be specified in such order, and may so fix different such prices in relation to different such sets of conditions :

AND WHEREAS it is enacted by sub-section (2) of Section 3 of the said Act that the provisions specified therein shall apply in respect of bread (price) orders :

AND WHEREAS it is enacted by sub-section (1) of Section 4 of the said Act, that the Minister for Industry and Commerce may by any bread (price) order prohibit the sale or offering for sale in the area to which such order applies of bread of any kind to which such order applies, unless such bread is so sold or offered for sale either (i) in units of less than eight ounces in weight or (ii) in units of one pound or multiples of one pound in weight :

NOW, THEREFORE, the Minister for Industry and Commerce in exercise of the power conferred on him by Section 3 of the Bread (Regulation of Prices) Act, 1936 (No. 29 of 1936) and of all and every power him in this behalf enabling, hereby orders as follows :—

1. This Order may be cited for all purposes as the Bread (Price) (No. 1) Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. This Order shall apply only to bread which is commonly known as " Batch Bread," that is to say, bread which is not baked in containers and is sold or offered for sale in loaves of which the outside is not all crust.

4. The maximum price at which bread may be sold or offered for sale shall be as follows, that is to say :—

(a) In the case of bread sold or offered for sale per four pound unit, retail, by a person other than the baker thereof in a shop owned by such person, delivery being taken by the purchaser at such shop, such price (hereinafter referred to as " the said price ") set out in the schedule hereto in accordance with the variation in the standard price of flour per sack of 280 pounds,

(b) In the case of bread sold or offered for sale per four pound unit, retail, delivery being made by the vendor to the purchaser at some place other than the place of sale, the said price,

(c) In the case of bread sold or offered for sale per four pound unit, retail, from a vehicle owned by the vendor, immediate delivery being taken by the purchaser, the said price,

(d) In the case of bread sold or offered for sale per four pound unit, retail, by the baker thereof in a shop owned by him, delivery being taken by the purchaser at such shop, the said price less one penny,

(e) In the case of bread sold or offered for sale per four pound unit, wholesale, delivery being taken by the purchaser at the place where such bread is kept by the vendor, the said price less one penny and less ten per cent. on the sum remaining after the deduction of the said penny from the said price,

(f) In the case of bread sold or offered for sale per four pound unit, wholesale, delivery being made by the vendor to the purchaser at some place other than the place where such bread is kept by the vendor, the said price less ten per cent.,

(g) In the case of bread sold or offered for sale under the like set of conditions as is mentioned in any one of the six preceding sub-clauses (a) to ( f ) save that it is sold or offered for sale per unit of one pound or other multiples of one pound than four pounds, the price per any such unit which is pro rata with the maximum price per four pound unit specified in this clause of this order in respect of bread sold or offered for sale under the like set of conditions save that it is sold or offered for sale per unit of four pounds.

5. Bread to which this Order applies shall not be sold or offered for sale in the area to which this Order applies unless it is sold or offered for sale either (i) in units of less than eight ounces in weight or (ii) in units of one pound or multiples of one pound in weight.

6. This Order shall apply to the whole of Saorstát Éireann.

7. This Order shall come into force on the 16th day of November, 1936.
