NIGHT WORK (BAKERIES) (THE PERIOD OF NIGHT) ORDER, 1937.

NIGHT WORK (BAKERIES) (THE PERIOD OF NIGHT) ORDER, 1937.

THE NIGHT WORK (BAKERIES) (THE PERIOD OF NIGHT) ORDER, 1937, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 9TH DAY OF JANUARY, 1937, PURSUANT TO SECTION 4 of THE NIGHT WORK (BAKERIES) ACT, 1936 .

WHEREAS it is enacted by sub-section (1) of Section 4 of the Night Work (Bakeries) Act, 1936 , that the Minister for Industry and Commerce, after consultation with persons who in his opinion are representative of employers interested in bakeries and with persons who in his opinion are representative of workers so interested, may by order make regulations prescribing in accordance with that section a period of not less than seven hours as the period of night for the purposes of the Act and the Minister may, if he so thinks fit, fix different such periods in respect of different parts of the year and in respect of different specified areas:

AND WHEREAS it is enacted by sub-section (2) of the said Section 4 that every period prescribed as the period of night by regulations made under that section shall include the special period which, subject to the provisions of that section, shall be the period between eleven o'clock, p.m., on any day and five o'clock, a.m., on the next following day:

AND WHEREAS it is further enacted by sub-section (6) of the said Section 4 that the Minister shall, by every order made under that section, fix the date on which such order shall come into operation, which date shall not in any case be less than fourteen days after the date on which such order is made:

NOW, THEREFORE, the Minister for Industry and Commerce, in exercise of the powers conferred on him by Section 4 of the Night Work (Bakeries) Act, 1936 , and of every and any other power him in this behalf enabling, and after consultation with representatives of employers and representatives of workers pursuant to sub-section (1) of the said Section 4, hereby orders as follows, that is to say:—

1. This Order may be cited for all purposes as the Night Work (Bakeries) (The Period of Night) Order, 1937.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this order and the regulations made thereunder in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The following regulations shall have effect for the purposes of Section 4 of the Night Work (Bakeries) Act, 1936 , that is to say:—

The period between ten o'clock p.m. on any day and six o'clock a.m. on the next following day shall be the period of night for the purposes of the Night Work (Bakeries) Act, 1936 .

4. This Order shall come into operation on the 1st day of February, 1937.
