THE ROAD TRANSPORT ACT, 1933 (PART II) REGULATIONS ORDER, 1933 (AMENDMENT) ORDER, 1937. | ||
In pursuance of the power conferred on him by Section 6 of the Road Transport Act, 1933 (No. 8 of 1933), and of every and any other power him in this behalf enabling, the Minister for Industry and Commerce, with the consent of the Minister for Finance and after consultation with the Minister for Justice, hereby makes the following regulations for the purposes of Section 30 of the said Act as amended by Section 12 of the Road Transport Act, 1934 (No. 17 of 1934), that is to say :— | ||
1. This Order may be cited for all purposes as the Road Transport Act, 1933 (Part II) Regulations Order, 1933 (Amendment) Order, 1937. | ||
2. The Interpretation Act, 1923 , shall apply to the Interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||
3. Every word and expression to which a particular meaning is given by the Road Transport Act, 1933 (No. 8 of 1933) and the Road Transport Act, 1934 (No. 17 of 1934) for the purposes of the said Acts has in this Order the meaning so given to it. | ||
4. Where in respect of an application for a vehicle plate under Section 30 of the Road Transport Act, 1933 (No. 8 of 1933), the following conditions are complied with, that is to say :— | ||
(i) a vehicle in respect of which a vehicle plate has been issued ceases to be duly licensed, and | ||
(ii) such vehicle plate is on such cesser delivered to a member of the Gárda Síochána at the plate issuing station at which such vehicle plate was issued, and | ||
(iii) the application is duly made within nine months after such delivery for the issue of a vehicle plate in respect of such vehicle, | ||
the fee payable on such application for the issue of a vehicle plate shall, anything in the Road Transport Act, 1933 (Part II), Regulations Order, 1933 (S.R. & O., 1933, No. 120), to the contrary notwithstanding be two shillings. | ||
5. Every application for a vehicle plate under the foregoing regulation shall be in the Form R.T. 16 set out in the Schedule hereto. | ||
6. Part III (Vehicle Plates) and Part IV (Fees) of the Road Transport Act, 1933 (Part II), Regulations Order, 1933, shall mutatis mutandis apply to every application for a vehicle plate made under the foregoing regulations and to every fee paid in respect of every such application. | ||

(1) Important.—In the case of an applicant not resident in the Dublin or Cork Postal Areas this application form should, in the first instance, be presented at any Head Post Office in the Saorstát together with the sum of two shillings, being the prescribed fee payable on application for a vehicle plate, when the application form will be transmitted to the Revenue Commissioners for stamping. The application form should be reclaimed within a few days after lodgment at the Head Post Office and then presented at the vehicle plate issuing station specified in the applicant's merchandise licence, together with the applicant's registration book or books and his merchandise licence. | ||
In the case of an applicant resident in the Dublin Postal Area this application form should be presented at the Office of the Revenue Commissioners (Stamping Branch) Dublin Castle, together with the sum of two shillings, being the prescribed fee payable on an application for a vehicle plate. The application form should when stamped be presented at the vehicle plate issuing station as indicated above. | ||
In the case of an applicant resident in the Cork Postal Area this application form should be presented at the Office of the Distributor of Stamps, Custom House, Cork, together with the sum of two shillings, being the prescribed fee payable on an application for a vehicle plate. The application form should when stamped be presented at the vehicle plate issuing station as indicated above. | ||
(2) It is provided by Section 30 (5) of the Road Transport Act, 1933 , that a Chief Superintendent of the Gárda Síochána shall not issue a vehicle plate in respect of any mechanically propelled vehicle unless he is satisfied that such vehicle is duly licensed under Section 13 of the Finance Act, 1920, as amended by subsequent enactments. | ||
(3) The signature should correspond with the name of the licensee as shown in the merchandise licence, and in the case of a limited liability company should be authenticated by the signature of a director, secretary, or other responsible officer of the company. | ||
(4) Applicant should clearly describe the type of vehicle, e.g., " motor lorry" " motor tractor", " steam lorry", " steam tractor". | ||
(5) An application on this form for the issue of a vehicle plate can only be accepted if made within nine months after the date on which the vehicle plate previously issued was delivered to a member of the Gárda Síochána. | ||
