THE NIGHT WORK (BAKERIES) (EXCEPTIONAL WORK FOR A LIMITED PERIOD) (No. 6) ORDER, 1937, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 25TH DAY OF NOVEMBER, 1937, PURSUANT TO SUB-SECTION (2) OF SECTION 5 of THE NIGHT WORK (BAKERIES) ACT, 1936 . | ||
WHEREAS it is enacted by sub-section (2) of Section 5 of the Night Work (Bakeries) Act, 1936 , that the Minister for Industry and Commerce may after such consultation as is mentioned in sub-section (1) of the said section by order make regulations prescribing as exceptional work for a limited period specified in such regulations all or any of the processes of manufacture carried on in any bakery to which this Act applies if the carrying on of such processes in the period of night is in the opinion of the Minister necessary for the carrying on of such bakery during such specified period owing to— | ||
(a) an unusual pressure of work, or | ||
(b) national emergency, | ||
and whenever the Minister makes such regulations any process of manufacture prescribed thereby as exceptional work shall, for the period specified in such regulations, be exceptional work for the purposes of this Act. | ||
NOW, THEREFORE, the Minister for Industry and Commerce in exercise of the powers conferred on him by sub-section (2) of Section 5 of the Night Work (Bakeries) Act, 1936 , and of every and any other power him in this behalf enabling and after consultation with representatives of employers and representatives of workers pursuant to the said sub-section and being of opinion that owing to an unusual pressure of work the carrying on in the period of night of all the processes of manufacture of certain classes of flour confectionery that is to say cakes of not less than two pounds in weight each carried on in any bakery to which the Act applies is necessary for the carrying on of such bakery during the limited period specified in the schedule hereto hereby orders as follows, that is to say:— | ||
1. This Order may be cited for all purposes as the Night Work (Bakeries) (Exceptional Work for a Limited Period) (No. 6) Order, 1937. | ||
2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order and the regulations made thereunder in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||
3. The following regulations shall have effect for the purposes of sub-section (2) of Section 5 of the Night Work (Bakeries) Act, 1936 , that is to say:— | ||
All the processes of manufacture of certain classes of flour confectionery that is to say cakes of not less than two pounds in weight each carried on in any bakery to which the Act applies shall be exceptional work during the limited period specified in the schedule hereto. | ||
