DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

The Minister for Local Government and Public Health in exercise of the powers vested in him by the Poor Relief (Ireland) Acts, 1838 to 1914, as amended by the Local Government (Dublin) (Amendment) Act, 1931 , the Limerick City Management Act, 1934 , and the Local Government (Temporary Provisions) Acts, 1923 and 1924, and by every county scheme confirmed or amended by or in pursuance of the said last mentioned Acts, does by this his Order, make the following regulations, that is to say:—

(1) This Order may be cited as the Public Assistance Contracts (Fair Wages) Order, 1938.

(2) In this Order the expression "public assistance authority" means the local authority to which is entrusted the administration of the relief of the poor in any county or county borough or poor law union.

In every contract in writing to be entered into by a public assistance authority for the supply of goods or materials or the execution of any work or repairs the following clause shall be inserted:—

" The contractor shall in the execution of this contract pay rates of wages and observe hours of labour not less favourable than those commonly recognised by employers and trade societies (or in the absence of such recognised wages and hours, those which in practice prevail amongst good employers) in the trade in the district where the work is carried out. Where there are no such wages and hours recognised or prevailing in the district, those recognised or prevailing in the nearest district in which the general industrial circumstances are similar shall be adopted. Further, the conditions of employment generally accepted in the district in the trade concerned shall be taken into account in considering how far the terms of this clause are being observed. The contractor shall be prohibited from transferring or assigning, directly or indirectly, to any person or persons whatever any portion of his contract without the written permission of the public assistance authority. Sub-letting other than that which may be customary in the trade concerned shall be prohibited. The contractor shall be responsible for the observance of this clause by a sub-contractor."
