AIR RAID PRECAUTIONS EQUIPMENT (IMPORTATION AND SALE) ORDER, 1940.

I, SEÁN MOYLAN, Parliamentary Secretary to the Minister for Defence, in exercise of the powers conferred on the Minister for Defence by Section 63 of the Air-raid Precautions Act, 1939 (No. 21 of 1939), and delegated to me under Section 6 of the Emergency Powers Act, 1939 (No. 28 of 1939), and of every and any other power me in this behalf enabling, do hereby make the following order, that is to say :—

1.—(1) This Order may be cited as the Air-raid Precautions Equipment (Importation and Sale) Order, 1940.

(2) This Order shall come into operation on the 30th day of March, 1940.

2. In this Order—

the expression " the Minister " means the Minister for Defence ;

the expression " air-raid precautions equipment " means respirators, filters and other appliances and materials, substances, liquids and solutions for the individual or collective protection of persons or animals against the inhalation of poison gas or any parts of such respirators, filters or appliances.

3.—(1) No person shall import any article of air-raid precautions equipment unless either—

(a) such article is imported under and in accordance with a licence issued by the Minister under the next following paragraph, and such licence is at the time of importation delivered to the proper officer of Customs and Excise, or

(b) such article is carried by the person importing it and is intended for the personal use of that person.

(2) The Minister may, whenever and so often as he thinks fit, issue a licence to import a specified number or a specified quantity of any specified articles of air-raid precautions equipment, and may attach to any such licence such conditions as he thinks proper.

(3) The Minister may at any time revoke any licence issued under the next preceding paragraph.

4.—(1) No person shall sell any article of air-raid precautions equipment unless he is the holder of a licence issued by the Minister under the next following paragraph authorising him to sell articles of air-raid precuations equipment.

(2) The Minister may, whenever and so often as he thinks fit, issue to any person a licence authorising such person to sell articles of air-raid precautions equipment.

(3) The Minister may at any time revoke any licence issued under the immediately preceding paragraph.
