CONTROL OF IMPORTS (QUOTA No. 39, SECOND PERIOD, ADDITIONAL QUOTA) ORDER, 1940. | ||
WHEREAS it is enacted by subsection (4) of section 6 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, that whenever the Government has, by order made under that section, appointed a quota in respect of any quota period, the Government may, if they so think fit, by Order made before the expiration of such quota period increase such quota by such amount (in that Act referred to as an additional quota) as they think proper : | ||
AND WHEREAS it is enacted by subsection (3) of the said section 6, as so adapted, that whenever the Government by Order made under the said section 6 appoints a quota, the Government may, if they so think fit, by the same order direct that a specified proportion (in the said Act referred to as a special quota) of the said quota shall consist of goods which are shown to the satisfaction of the Revenue Commissioners either (as shall be specified in such order)— | ||
(a) to have been manufactured or produced in a specified country, or | ||
(b) to have been consigned to the importer from a specified country, or | ||
(c) to have been manufactured or produced in a specified country and consigned to the importer from that country : | ||
AND WHEREAS it is enacted by subsection (3) of section 5 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), as so adapted, that whenever the Government, by an order made under section 6 of the said Control of Imports Act, 1934 , appoint an additional quota, they may, if they so think fit, by the same order direct that such additional quota or any specified portion thereof shall be in itself a special quota or shall be added to and form part of a special quota previously appointed : | ||
AND WHEREAS by the Control of Imports (Quota No. 39, Second Period) Order, 1940 ( S. R. & O. No. 293 of 1940 ), made under the said section 6, the Government appointed the period beginning on the 1st day of November, 1940, and ending on the 31st day of January, 1941, to be the second quota period under the Control of Imports (Quota No. 39) Order, 1940 ( S. R. & O. No. 200 of 1940 ), which relates to certain woven piece goods of cotton, and appointed fifty thousand square yards of the woven piece goods to which the said Control of Imports (Quota No. 39) Order, 1940, applies to be the quota in respect of the said second quota period ; and directed under the powers conferred on them by subsection (3) of the said section 6, that of the said quota in respect of the said second quota period, forty-nine thousand square yards should be woven piece goods which are shown, to the satisfaction of the Revenue Commissioners, to have been manufactured either in the United Kingdom of Great Britain and Northern Ireland or in the Dominion of Canada : | ||
AND WHEREAS it is enacted by subsection (1) of section 9 of the Control of Imports Act, 1934 , as adapted as aforesaid, and as amended by subsection (1) of section 10 of the Control of Imports (Amendment) Act, 1937 (No. 8 of 1937), as so adapted, that whenever and so long as a quota order made by the Government under the Control of Imports Act, 1934 , is in force, any person who is for the time being registered in the register of importers maintained in pursuance of the Control of Imports Act, 1934 , for the purposes of such quota order may, not less than fourteen clear days before the commencement of any quota period under such quota order or, in the case of an application in relation to an additional quota, within such time as shall be appointed in that behalf by the order fixing such additional quota, apply in the prescribed manner to the Minister for Industry and Commerce for a licence to import during such quota period a specified quantity of goods to which the said quota order applies : | ||
NOW, the Government, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows :— | ||
1. This Order may be cited as the Control of Imports (Quota No. 39, Second Period, Additional Quota) Order, 1940. | ||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. | ||
3. The quota appointed by the Control of Imports (Quota No. 39, Second Period) Order, 1940, in respect of the second quota period appointed by that Order is hereby increased by fifty thousand square yards of the woven piece goods to which the Control of Imports (Quota No. 39) Order, 1940, applies, to the intent that the said fifty thousand square yards shall be an additional quota in respect of the said second quota period, and the total quota in respect of the said second quota period shall be one hundred thousand square yards of the woven piece goods to which the said Control of Imports (Quota No. 39) Order, 1940, applies. | ||
4. It is hereby directed that the whole of the additional quota appointed by the next preceding paragraph of this Order shall be woven piece goods which are shown, to the satisfaction of the Revenue Commissioners, to have been manufactured either in the United Kingdom of Great Britain and Northern Ireland or in the Dominion of Canada. | ||
5. Every application made in relation to the additional quota specified in this Order for a licence to import any quantity of the articles to which the Control of Imports (Quota No. 39) Order, 1940, applies, shall be made within seven days after the date of this Order. | ||
