KILDARE COUNTY SCHEME (AMENDMENT) ORDER, 1941.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

THE LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923 .

KILDARE COUNTY SCHEME.

WHEREAS by an Order under his Seal of Office bearing date the twenty-eighth day of June, 1923, called the Kildare County Scheme Order, 1923, the Minister for Local Government, in pursuance of section 5 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as " the Act ") did amend and modify the existing County Scheme relating to the Administrative County of Kildare as set out in the Schedule to and as confirmed by the Act in such way as to bring it into conformity with the provisions of the scheme set out in the Schedule to the said Order and did substitute the said provisions for the provisions of the said existing County Scheme (which said first-mentioned provisions are in the said Order and this Order referred to as the Kildare County Scheme) :

AND WHEREAS the powers and duties of the Minister for Local Government are now voted in the Minister for Local Government and Public Health (hereinafter referred to as "the Minister") :

AND WHEREAS the Kildare County Scheme has come into operation and the Minister did in pursuance of section 5 of the Act amend the Kildare County Scheme, by the County Schemes (General Amendment) Order, 1925, and the County Schemes (General Amendment) Order, 1933, and the County Schemes (General Amendment) Order, 1939 :

AND WHEREAS the Minister deems it necessary further to amend the Kildare County Scheme in the manner hereinafter appearing, and did on the thirty-first day of October, 1941, give to the Council of the Administrative County of Kildare one month's notice of his intention to make the said amendment :

AND WHEREAS no representations have been made to the Minister by the Council of the said County within such month in respect of the said amendment :

NOW, THEREFORE, the Minister in exercise of the powers given to him by section 5 of the Act, and of all other powers in this behalf enabling him, the said month having expired, by this his Order, orders and directs as follows, that is to say :.—

1. From and after the date hereof the Kildare County Scheme shall be amended—

(a) by inserting in Article 12 thereof after sub-article (i) the following additional sub-article, that is to say :—

" (i) (a) From and after the first day of January, 1942, the Joint Committee of the Kildare County Infirmary shall be abolished under section 7 of the Local Government (Temporary Provisions) Act, 1923 , and their powers and duties in relation to the relief of the poor in the County, as modified by the said Act and by this Scheme, shall be transferred to the Board of Health. "

and

(b) by substituting for sub-article (i) of Article 15 thereof a new sub-article as follows :—

" (i) Subject to the provisions of this Scheme and to any directions of the Minister in that behalf, the Board of Health shall provide and maintain for the reception and maintenance of persons in the County eligible for relief :—

(a) A County Home at Athy for aged and infirm persons, chronic invalids and expectant mothers.

(b) A County Hospital at Kildare for the treatment of medical, surgical, and maternity cases.

(c) A District Hospital at Naas for the treatment of medical, surgical, and maternity cases.

(d) A Fever Hospital at Naas for the treatment of cases of infectious and contagious diseases.

(e) A District Hospital at Athy for the treatment of medical, surgical, and maternity cases.

(f) With the approval of Minister, such other institutions as they may deem desirable for the relief of the poor in their county. "

2. This Order may be cited as the Kildare County Scheme (Amendment) Order, 1941.
