CIVIL SERVICE (STABILISATION OF BONUS) (AMENDMENT) REGULATIONS, 1942. | ||||||||||||||||||||||||||||||||||||||
WHEREAS it is enacted by subsection (1) of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), as adapted in consequence of the enactment of the Constitution, that the Minister for Finance may from time to time make regulation for controlling the Civil Service of the State and providing for the classification, remuneration, and other conditions and terms of service of all persons employed therein whether permanently or temporarily : | ||||||||||||||||||||||||||||||||||||||
AND WHEREAS it is enacted by subsection (3) of section 2 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), that there shall be paid to all officers and servants appointed by any Minister such salaries and remunerations as the Minister for Finance may from time to time determine: | ||||||||||||||||||||||||||||||||||||||
NOW, I, SEÁN T. O CEALLAIGH, Minister for Finance, in exercise of the powers conferred on me by subsection (1) of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), and of the powers conferred on me by subsection (3) of section 2 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), and of every and any other power me in this behalf enabling, hereby make the following regulations :— | ||||||||||||||||||||||||||||||||||||||
1. (1) These Regulations may be cited as the Civil Service (Stabilisation of Bonus) (Amendment) Regulations, 1942. | ||||||||||||||||||||||||||||||||||||||
(2) The Principal Regulations and these Regulations may be cited together as the Civil Service (Stabilisation of Bonus) Regulations, 1940 and 1942. | ||||||||||||||||||||||||||||||||||||||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations. | ||||||||||||||||||||||||||||||||||||||
3. (1) In these Regulations— | ||||||||||||||||||||||||||||||||||||||
the expression " the Principal Regulations " means the Civil Service (Stabilisation of Bonus) Regulations, 1940 ( S. R. & O. No. 177 of 1940 ), | ||||||||||||||||||||||||||||||||||||||
the expression " basic salary " does not include payments in respect of overtime or allowances in respect of children, | ||||||||||||||||||||||||||||||||||||||
the word " whole-time " means that the person in respect of whom the expression is used is required to devote the whole of his time to the discharge of his official duties, | ||||||||||||||||||||||||||||||||||||||
the word " part-time " means that the person in respect of whom the word is used is required to devote part only of his time to the discharge of his official duties, | ||||||||||||||||||||||||||||||||||||||
the expression " the Civil Service " and " index number " have the same meanings as they respectively have in paragraph 4 of the Principal Regulations. | ||||||||||||||||||||||||||||||||||||||
(2) In the Schedule hereto the word " child " means a child who has not attained the age of sixteen years, but includes also a child who is an invalid and has not attained the age of twenty-one years and a child who is attending school after attaining the age of sixteen years and has not attained the age of twenty-one years, and the word " children " shall in the said Schedule be construed accordingly. | ||||||||||||||||||||||||||||||||||||||
4. (1) These Regulations apply to every person to whom the Principal Regulations for the time being apply. | ||||||||||||||||||||||||||||||||||||||
(2) In the application of these Regulations to a person who is, at the date of these Regulations, a person to whom the Principal Regulations apply, the word " remuneration " means remuneration payable in respect of a period beginning on or after whichever of the following dates is the later, that is to say, the 1st day of June, 1942, or the date on which the Principal Regulations began to apply to him. | ||||||||||||||||||||||||||||||||||||||
5. For the purpose of the application of these Regulations to a person for the time being belonging to the temporary clerical or other temporary class and in receipt of remuneration at a rate which is related to standard inclusive remuneration and would, but for the Principal Regulations, be varied in accordance with variations in the index number, the basic salary of such person shall be taken to be the basic equivalent (calculated by reference to the appropriate index number) of the said standard inclusive remuneration. | ||||||||||||||||||||||||||||||||||||||
6. Notwithstanding anything contained in paragraph 4 of the Principal Regulations, the remuneration of every person who is for the time being a person mentioned in the second column of the Schedule hereto at any particular reference number shall, as respects so much (whether the whole or a part) of his basic salary as is specified in the third column of the said Schedule at the said reference number, be calculated by reference to the index number which exceeds by the number of points stated in the fourth column of the said Schedule at the said reference number the index number or numbers specified in the said paragraph 4 in respect of him. | ||||||||||||||||||||||||||||||||||||||
7. A person who would be a person mentioned in the second column of the Schedule hereto at any particular reference number but for the fact that his basic salary exceeds the maximum basic salary specified in that column at that reference number shall not receive less total remuneration than he would have received if his basic salary had been equal to the said maximum basic salary. | ||||||||||||||||||||||||||||||||||||||
8. Every question or dispute which shall arise as to the amount of any person's basic salary, or as to the remuneration to be included therein, or as to whether a child is or is not an invalid or is or is not attending school or is or is not dependent on its mother shall be decided by the Minister for Finance whose decision thereon shall be final. | ||||||||||||||||||||||||||||||||||||||
