IRISH LAND COMMISSION.

RULES UNDER SECTION 7 of THE LAND ACT, 1933 .

I, SEÁN MOYLAN, Minister for Lands, by virtue of the powers conferred upon me by Section 7 of the Land Act, 1933 , and of all other powers enabling me in this behalf with the concurrence of the majority of the Committee constituted pursuant to the provisions of the said Section, do hereby make the annexed Appeal Tribunal (Amendment) Rules.

Title.

1. These Rules may be cited as the Appeal Tribunal (Amendment) Rules, 1944.

Definition.

2. In these Rules the expression " the Principal Rules " means the Appeal Tribunal Rules.

Interpretation.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to the interpretation of these Rules in like manner as it applies to the interpretation of an Act of the Oireachtas.

Saving of existing Rules.

4. All existing rules and orders made under the Land Purchase Acts, save in so far as they are revoked or amended by or are inconsistent with these rules, shall remain in force as if these rules had not been made.

Amendment of Rule 3 of the Principal Rules.

5. Rule 3 of the Principal Rules is hereby revoked and the following Rule substituted therefor, that is to say :—

"3. The notice of motion shall be for the first opportunity and shall be served personally or by registered post on all parties directly affected by the appeal or, where they are represented by solicitors, on their respective solicitors within twenty-eight clear days from the date on which the Order appealed against was made or, where the Order appealed against is an Order made by the Land Commission fixing the standard purchase annuity of a holding or of a parcel of land or the price of untenanted land, within twenty-eight clear days from the date when notice of the amount so fixed is sent by the Land Commission by registered post to the parties or their solicitors or to the owner of the untenanted land as the case may be, and within ten days of the date of the service of the notice of motion or the last of such services, the appellant shall lodge with the Registrar of the Land Commission a copy of the Notice of Appeal endorsed with the time and mode of service on the interested parties."
