DRAPERY AND BOOT SHOPS (HOURS OF TRADING ON WEEKDAYS) (WESTPORT) ORDER, 1945.

DRAPERY AND BOOT SHOPS (HOURS OF TRADING ON WEEKDAYS) (WESTPORT) ORDER, 1945.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 25 of the Shops (Hours of Trading) Act, 1938 (No. 3 of 1938), and after due compliance with subsection (1) of section 4 of the said Act, hereby order as follows :—

1. (1) This Order may be cited as the Drapery and Boot Shops (Hours of Trading on Weekdays) (Westport) Order, 1945.

(2) This Order shall come into operation on the 1st day of January, 1946.

2. In this Order—

the expression " shop to which this Order applies " means any shop situate in the trading area in which there is carried on the business of selling drapery or footwear, whether any other business is or is not carried on in the shop ;

the expression " the trading area " means the area declared by Article 3 of this Order to be a trading area for the purposes of this Order.

3. The urban district of Westport shall be a trading area for the purposes of this Order.

4. (1) It shall not be lawful for the proprietor of a shop to which this Order applies to open or keep open the shop for the serving of customers—

(a) on any weekday (other than Saturday), before the hour of 9 a.m. or after the hour of 6 p.m., or

(b) on any Saturday, before the hour of 9 a.m. or after the hour of 9 p.m.

(2) Notwithstanding anything contained in paragraph (1) of this Article—

(a) the proprietor of a shop to which this Order applies may lawfully keep open the shop for the serving of customers between the hours of 9 a.m. and 9 p.m. on any of the following days which is a weekday, that is to say, the 16th day of March, the 31st day of October and the 1st day of November, in any year,

(b) the following provisions shall apply with respect to the six weekdays next preceding Christmas Day in any year, that is to say, the proprietor of a shop to which this Order applies may lawfully keep open the shop for the serving of customers—

(i) on each of the first two of those weekdays, between the hours of 9 a.m. and 7 p.m.,

(ii) if either of those two weekdays is Saturday, between the hours of 9 a.m. and 9 p.m. on Saturday,

(iii) on each of the next four weekdays, between the hours of 9 a.m. and 9 p.m.
