CÓRAS IOMPAIR ÉIREANN (ACQUISITION OF LAND AT LIMERICK) ORDER, 1947. | ||
WHEREAS it is enacted by subsection (1) of section 59 of the Railways Act, 1924 (No. 29 of 1924), that, on the application of a railway company, for enabling such company to make and provide any alteration, extension or improvement mentioned in section 45 of the Railway Clauses Act, 1845, the Minister for Industry and Commerce may, after compliance with the provisions of the said section 59, authorise the railway company to acquire the land and easements and to construct the works necessary to effect the alterations, extensions, and improvements aforesaid : | ||
AND WHEREAS it is enacted by subsection (3) of the said section 59 that an order made under that section may incorporate— | ||
(a) the Acquisition of Land (Assessment of Compensation) Act, 1919, with the modification that the expression " public authority " shall include the said railway company, and | ||
(b) the Lands Clauses Acts, so far as the same are not inconsistent with the said Acquisition of Land (Assessment of Compensation) Act, 1919 : | ||
AND WHEREAS Córas Iompair Éireann have, for enabling the said company to construct and provide a goods store, railway sidings, a shelter for vehicles, and stables, applied to the said Minister for an order authorising the said Company to acquire the lands specified in the First Schedule to this Order and to construct the works specified in the Second Schedule to this Order: | ||
AND WHEREAS the construction and provision of such goods store, railway sidings, shelter and stables is an alteration, extension or improvement mentioned in section 45 of the Railway Clauses Act, 1845, and the said lands and works are necessary therefor : | ||
NOW, the Minister for Industry and Commerce, in exercise of the powers conferred on him by section 59 of the Railways Act, 1924 (No. 29 of 1924), and after compliance with the provisions of the said section 59 and not being of the opinion specified in subsection (4) of the said section 59, hereby orders as follows :— | ||
1. This Order may be cited as the Córas Iompair Éireann (Acquisition of Land at Limerick) Order, 1947. | ||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. | ||
3. Córas Iompair Éireann are hereby authorised to acquire the lands specified in the First Schedule to this Order and to construct the works specified in the Second Schedule to this Order. | ||
4. This Order incorporates— | ||
(a) the Acquisition of Land (Assessment of Compensation) Act, 1919, with the modification that the expression " public authority " shall include Córas Iompair Éireann, and | ||
(b) the Lands Clauses Acts, so far as the same are not inconsistent with the said Acquisition of Land (Assessment of Compensation) Act, 1919. | ||

FIRST SCHEDULE. | ||
LANDS TO BE ACQUIRED. | ||
The lands comprising approximately 3 roods and 9 perches which are situated in the parish of Saint Michael in the county of the city of Limerick and are shown coloured blue, green and red in the copy of sheet 5, XV of the Ordnance Survey Map deposited with the Minister for Industry and Commerce by Córas Iompair Éireann for the purposes of their application for this Order. | ||
SECOND SCHEDULE. | ||
WORKS TO BE CONSTRUCTED. | ||
(a) Portion of a Goods Store 65-feet long by 40-feet wide by 30-feet high, or thereabouts. | ||
(b) A double line of railway sidings commencing at a point on an existing siding in Limerick Goods Yard, entering the lands to be acquired on the South-Western boundary and thence running in a Northerly direction and leaving the said lands at the North-Western boundary, the total length of railway sidings on the lands to be acquired being 53 yards or thereabouts. | ||
(c) A shelter for vehicles 140-feet long by 30-feet wide by 20-feet high or thereabouts. | ||
(d) A range of stables with lofts over, 120-feet long by 20-feet wide by 25-feet high or thereabouts. | ||
