We, the Superior Courts Rules Committee constituted pursuant to the provisions of Section 67 of the Courts of Justice Act, 1936 , by virtue of the powers conferred upon us by Section 36 of the Courts of Justice Act, 1924 , and Section 68 of the Courts of Justice Act, 1936 , and of all other powers enabling us in this behalf, do hereby make the annexed Rules of Court.

1. These Rules may be cited as the High Court Rules (No. 1), 1952.

2. The Judges to be placed upon the rota for the trial of election petitions in each year under the provisions of the Parliamentary Elections Act, 1868, and any Act applying or amending the same shall be selected out of the judges of the High Court as follows :--

(a) The selection shall be made on or before the third day of the Michaelmas Term of every year.

(b) If the Judges of the High Court fail to agree upon the Judges to be selected they, or a majority of them, shall meet on or before the said day and shall by a majority of the votes of those present at such meeting select three of the Judges of the High Court to be placed upon the rota for the trial of Parliamentary election petitions during the ensuing year.

(c) If in any case the Judges present at the time of this meeting to make such selection are equally divided in their choice of any Judge to be placed on the rota, the President of the High Court or in the case of his absence the Senior Judge then present, shall have a second or casting vote.

(d) The choice of a Judge to fill any occasional vacancy on the rota or to assist the Judges on the rota as an additional Judge shall be made in like manner.
