CONTROL OF IMPORTS (QUOTA NO. 47) (ROAD VEHICLES) ORDER, 1952.

CONTROL OF IMPORTS (QUOTA NO. 47) (ROAD VEHICLES) ORDER, 1952.

The Government, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, hereby order as follows :--

1. This Order may be cited as the Control of Imports (Quota No. 47) (Road Vehicles) Order, 1952.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order the expression " mechanically propelled vehicle " means a vehicle which derives its motive power from an internal combustion engine or from an electric motor or from a combination of such engine and such motor, but does not include--

(a) a mechanically propelled bicycle or tricycle, or

(b) a vehicle which is designed and constructed solely or primarily for the traction of vehicles or other articles.

4. Subject to the exceptions and qualifications mentioned in paragraph 5 of this Order, the importation on or after the 27th day of May, 1952, of mechanically propelled vehicles which are completely or substantially assembled and are primarily constructed or adapted for use on a public road for the carriage of goods (including burthen) or persons or both such goods and persons but not including vehicles which are designed and constructed for the carriage of more than fifteen persons (whether with or without goods) exclusive of the driver is hereby prohibited.

5. The prohibition effected by paragraph 4 of this Order shall not extend or apply to--

(a) articles which are imported under and in accordance with a licence in that behalf issued under the Control of Imports Acts, 1934 and 1937, or

(b) articles to which this Order is precluded from applying by section 4 of the Control of Imports (Amendment) Act, 1937 , or

(c) articles which are shown, to the satisfaction of the Revenue Commissioners, to be imported--

(i) temporarily only, or

(ii) for further manufacture and subsequent exportation, or

(iii) for such purposes and in such circumstances that the importation thereof without payment of any duty of customs could lawfully be permitted by virtue of section 17 or of paragraph (b) or paragraph (h) of section 18 of the Finance Act, 1936 (No. 31 of 1936), or of section 18 of the Finance Act, 1946 (No. 15 of 1946), or

(d) articles the importation of which is prohibited by the Control of Imports (Quota No. 8) Order, 1934 (S. R. & O., No. 287 of 1934), or

(e) an article which is shown, to the satisfaction of the Revenue Commissioners--

(i) to be imported by a trader in mechanically propelled vehicles for the purpose of re-sale, and

(ii) to be of a value for the purpose of the Customs Acts of not less than £1,300, and

(iii) to be a completely assembled mechanically propelled vehicle, and

(iv) to have been manufactured in the United Kingdom of Great Britain and Northern Ireland, or in the Channel Islands or in the Isle of Man or in Canada, and

(v) to be suitable only for the carriage of persons or of persons and their personal luggage, and

(vi) to be of a type which is ordinarily kept for the personal use of the owner and members of his family or household.

6. The 8th day of July, 1952, is hereby appointed to be the day on which the first quota period under this Order shall commence.
