S.I. No. 398/1953:

MERCHANT SHIPPING ACT, 1894 (ADAPTATION) ORDER, 1953.

MERCHANT SHIPPING ACT, 1894 (ADAPTATION) ORDER, 1953.

The Government, in exercise of the powers conferred on them by section 12 of the Adaptation of Enactments Act, 1922 (No. 22 of 1922), as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, hereby order as follows :--

1. This Order may be cited as the Merchant Shipping Act, 1894 (Adaptation) Order, 1953.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order--

" the Act " means the Merchant Shipping Act, 1894 ;

" Irish ship " has the same meaning as in the Merchant Shipping Acts, 1894 to 1952, and includes ships in the service of the State.

4. The reference in subsection (1) of section 418 of the Act to " the joint recommendation of the Admiralty and the Board of Trade " shall be construed as a reference to the recommendation of the Minister for Industry and Commerce.

5. The references in subsection (2) of section 418 and in section 424 of the Act to " British jurisdiction " and " British court " shall be construed as references to " the jurisdiction of the State" and " a court in the State," respectively.

6. The references in subsection (2) of section 418 and in section 424 of the Act to " British ships " shall be construed as references to Irish ships.

7. The reference in subsection (1) of section 420 of the Act to " any ship, British or foreign " shall be construed as a reference to any ship, Irish or foreign.
