THE TRANSPORT TRIBUNAL. CÓRAS IOMPAIR ÉIREANN (KILMESSAN-ATHBOY RAILWAY LINE) EXEMPTION ORDER, 1954.

THE TRANSPORT TRIBUNAL. CÓRAS IOMPAIR ÉIREANN (KILMESSAN-ATHBOY RAILWAY LINE) EXEMPTION ORDER, 1954.

WHEREAS Córas Iompair Éireann applied on the 1st day of October, 1952, and the 17th day of August, 1953, to the Transport Tribunal for Exemption Orders pursuant to Section 55 of the Transport Act, 1950 (No. 12 of 1950) in respect of the railway line between Kilmessan and Athboy and the services of trains thereon as specified in the Schedule hereto :

AND WHEREAS Notices of said applications were duly published in the manner and at the times directed by the said Tribunal ;

AND WHEREAS four objections by interested parties to the making of the Orders applied for were received by the said Tribunal, but one of these objections was subsequently withdrawn :

AND WHEREAS the said Tribunal held a Sitting for hearing of the said objectors and the Board on the 24th day of November, 1953, due notice whereof was given to the said parties :

AND WHEREAS after hearing at the said Sitting such of the said objectors as attended before them and also the Board the said Tribunal decided to make the Orders applied for without modifications and without any limitation as to the period of their operation :

NOW, WE, THE TRANSPORT TRIBUNAL, in exercise of the powers conferred on us by Section 55 of the Transport Act, 1950 (No. 12 of 1950) hereby order as follows :--

1. This Order may be cited as the Córas Iompair Éireann (Kilmessan-Athboy railway line) Exemption Order, 1954.

2. This Order shall come into operation on the first day of February, 1954.

3. Córas Iompair Éireann is hereby exempted from the obligation to operate the services of trains for passengers and merchandise as specified in Part I of the Schedule hereto.

4. Córas Iompair Éireann is hereby exempted from the obligation to restore all or any of the services of trains for passengers and merchandise as specified in Part II of the Schedule hereto.

SCHEDULE.

PART I.

All services of special trains for passengers and merchandise on the railway line between Kilmessan and Athboy in the County of Meath which were in operation immediately before the first day of June, 1950.

PART II.

All or any services of trains for passengers and merchandise on the railway line between Kilmessan and Athboy in the County of Meath which were temporarily discontinued under the Emergency Powers (Córas Iompair Éireann) (Reduction of Railway Services) Order, 1944.
