CONSULTATIVE HEALTH COMMITTEES (DUBLIN, CORK AND WATERFORD) REGULATIONS, 1954. |
||
The Minister for Health, in exercise of the powers conferred on him by section 48 of the Health Act, 1953 (No. 26 of 1953) hereby makes the following Regulations :-- |
||
1. These Regulations may be cited as the Consultative Health Committees (Dublin, Cork and Waterford) Regulations, 1954. |
||
2. These Regulations shall come into operation on the 20th day of April, 1954. |
||
3. There shall be established, in accordance with these Regulations, a consultative health committee for each of the following areas :-- |
||
(a) the county borough of Dublin and the county of Dublin ; |
||
(b) the county borough of Cork and the county of Cork and |
||
(c) the county borough of Waterford and the county of Waterford. |
||
4.--(1) The appointment of members of a consultative health committee under these Regulations shall be made by a county council at the annual meeting and by a city council at the quarterly meeting held next after every quinquennial election of members of such council. |
||
(2) The first appointment of members of a consultative health committee under these Regulations shall be made as soon as is convenient after the commencement of these Regulations. |
||
5.--(1) The consultative health committee established under these regulations for the county borough of Dublin and the county of Dublin shall be known as the Dublin Consultative Health Committee. |
||
(2) The functions of the Dublin Consultative Health Committee shall be to advise the Dublin City Manager and Town Clerk and the Dublin County Manager on general matters (other than conditions of employment of officers and servants, the amount or payment of grants or allowances or the making of any service available to an individual) relating to the exercise of the functions of the Right Honourable the Lord Mayor, Alderman and Burgesses of Dublin and the Council of the County of Dublin respectively, in relation to the operation of the Health Acts, 1947 and 1953. |
||
(3) During such time as the Local Government (Dublin) (Temporary) Act, 1948 (No. 15 of 1948) remains in operation it shall also be a function of the Dublin Consultative Health Committee to advise the Chief Executive Officer of the Dublin Board of Assistance on matters such as are referred to in sub-article (2) of this Article, in so far as they relate to the performance by the Dublin Board of Assistance of any functions of the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin and the Council of the County of Dublin under the Health Acts, 1947 and 1953. |
||
(4) The Dublin Consultative Health Committee shall consist of sixteen members, of whom nine shall be appointed by resolution of the Dublin City Council and seven by resolution of the Council of the County of Dublin. |
||
(5) The members of the Dublin Consultative Health Committee appointed by the Dublin City Council shall include-- |
||
(a) not less than three members of the Dublin City Council, at least one of whom shall be a member of the Dublin Board of Assistance ; |
||
(b) the Dublin City Medical Officer ; |
||
(c) the Resident Medical Superintendent of Saint Kevin's Hospital, Dublin ; |
||
(d) two other registered medical practitioners residing in the county borough of Dublin, each of whom is nominated by a body which, in the opinion of the Dublin City Council, is representative of registered medical practitioners practising in the said county borough ; |
||
(e) one person concerned with the management of a voluntary hospital. |
||
(6) The members of the Dublin Consultative Health Committee appointed by the Council of the County of Dublin shall include-- |
||
(a) not less than three members of the Council, at least one of whom shall be a member of the Balrothery Board of Assistance and at least one of whom shall be a member of the Rathdown Board of Assistance ; |
||
(b) the Dublin County Medical Officer ; |
||
(c) a senior medical officer of Saint Columcille's Hospital, Loughlinstown ; |
||
(d) one other registered medical practitioner residing in the county of Dublin, who is nominated by a body which, in the opinion of the Council of the County of Dublin, is representative of registered medical practitioners practising in the said county. |
||
(7) Sub-sections (4), (5) and (6) of section 48 of the Health Act, 1953 , shall apply to the Dublin Consultative Health Committee with the following modifications :-- |
||
(a) references to the council of the county shall be construed as references to the Dublin City Council and the Council of the County of Dublin distributively or respectively and not collectively ; |
||
(b) references to the county manager shall be construed as references to the Dublin City Manager and Town Clerk and the Dublin County Manager distributively or respectively and not collectively. |
||
6.--(1) The consultative health committee established under these Regulations for the county borough of Cork and the county of Cork shall be known as the Cork Consultative Health Committee. |
||
(2) The functions of the Cork Consultative Health Committee shall be to advise the Cork City Manager and Town Clerk and the Cork County Manager on general matters (other than conditions of employment of officers and servants, the amount or payment of grants or allowances or the making of any service available to an individual) relating to the exercise of the functions of the Lord Mayor, Aldermen and Burgesses of Cork and the Council of the County of Cork respectively in relation to the operation of the Health Acts, 1947 and 1953. |
||
(3) The Cork Consultative Health Committee shall consist of fifteen members, of whom seven shall be appointed by resolution of the Cork City Council and eight by resolution of the Council of the County of Cork. |
||
(4) The members of the Cork Consultative Health Committee appointed by the Cork City Council shall include-- |
||
(a) not less than three members of the Cork City Council, at least one of whom shall be a member of the Board of Public Assistance for the South Cork Public Assistance District ; |
||
(b) the Cork City Medical Officer ; |
||
(c) the Resident Medical Superintendent of Saint Finbarr's Hospital, Cork ; |
||
(d) one other registered medical practitioner residing in the county borough of Cork who is nominated by a body which, in the opinion of the Cork City Council, is representative of registered medical practitioners practising in the said county borough. |
||
(5) The members of the Cork Consultative Health Committee appointed by the Council of the County of Cork shall include-- |
||
(a) not less than three members of the Council, at least one of whom shall be a member of the Board of Public Assistance for the South Cork Public Assistance District ; |
||
(b) the Cork County Medical Officer ; |
||
(c) a senior medical officer in a health institution maintained by the Council of the County ; |
||
(d) two other registered medical practitioners, residing in the county of Cork, each of whom is nominated by a body which, in the opinion of the Council of the County of Cork, is representative of registered medical practitioners practising in the said county. |
||
(6) Sub-sections (4), (5) and (6) of section 48 of the Health Act, 1953 , shall apply to the Cork Consultative Health Committee with the following modifications :-- |
||
(a) references to the council of the county shall be construed as references to the Cork City Council and the Council of the County of Cork distributively or respectively and not collectively ; |
||
(b) references to the county manager shall be construed as references to the Cork City Manager and Town Clerk and the Cork County Manager distributively or respectively and not collectively. |
||
7.--(1) The consultative health committee established under these Regulations for the county borough of Waterford and the county of Waterford shall be known as the Waterford Consultative Health Committee. |
||
(2) The functions of the Waterford Consultative Health Committee shall be to advise the Waterford City Manager and Town Clerk and the Waterford County Manager on general matters (other than conditions of employment of officers and servants, the amount or payment of grants or allowances or the making of any service available to an individual) relating to the exercise of the functions of the Mayor, Alderman and Burgesses of Waterford and the Council of the County of Waterford respectively in relation to the operation of the Health Acts, 1947 and 1953. |
||
(3) The Waterford Consultative Health Committee shall consist of fourteen members, of whom six shall be appointed by resolution of the Waterford City Council and eight by resolution of the Council of the County of Waterford. |
||
(4) The members of the Waterford Consultative Health Committee appointed by the Waterford City Council shall include-- |
||
(a) not less than three members of the Waterford City Council, at least one of whom shall be a member of the Board of Public Assistance for the Waterford Public Assistance District ; |
||
(b) the Waterford City Medical Officer ; |
||
(c) one other registered medical practitioner residing in the county borough of Waterford who is nominated by a body which, in the opinion of the Waterford City Council, is representative of registered medical practitioners practising in the said county borough. |
||
(5) The members of the Waterford Consultative Health Committee appointed by the Council of the County of Waterford shall include-- |
||
(a) not less than three members of the Council, at least one of whom shall be a member of the Board of Public Assistance for the Waterford Public Assistance District ; |
||
(b) the Waterford County Medical Officer ; |
||
(c) the County Surgeon for the county of Waterford ; |
||
(d) two other registered medical practitioners residing in the county of Waterford, each of whom is nominated by a body which, in the opinion of the Council of the County of Waterford, is representative of registered medical practitioners practising in the said county. |
||
(6) Sub-sections (4), (5) and (6) of section 48 of the Health Act, 1953 , shall apply to the Waterford Consultative Health Committee with the following modifications-- |
||
(a) references to the council of the county shall be construed as references to the Waterford City Council and the Council of the County of Waterford distributively or respectively and not collectively. |
||
(b) references to the county manager shall be construed as references to the Waterford City Manager and Town Clerk and the Waterford County Manager distributively or respectively and not collectively. |
||
