MILITARY SERVICE REGISTRATION BOARD (PROCEDURE) RULES, 1937 (AMENDMENT) RULES, 1954.

MILITARY SERVICE REGISTRATION BOARD (PROCEDURE) RULES, 1937 (AMENDMENT) RULES, 1954.

I, OSCAR TRAYNOR, Minister for Defence, in exercise of the power conferred on me by subsection (6) of section 6 of the Army Pensions Act, 1932 (No. 24 of 1932), and of every and any other power me in this behalf enabling, hereby, with the consent of the Minister for Finance, testified by his signature hereto, make the following rules :--

1. These rules may be cited as the Military Service Registration Board (Procedure) Rules, 1937 (Amendment) Rules, 1954.

2. The Military Service Registration Board (Procedure) Rules, 1937 ( S. R. & O. No. 277 of 1937 ), are hereby amended--

(1) by the insertion in rule 4, immediately after the words " Act of 1937 " of the words " or under Part II of the Army Pensions Act, 1953 (No. 23 of 1953),"

(2) by the insertion in rule 5, immediately after the words " in the Form A.P. 56 in the Schedule hereto " of the words " and in the case of applications for allowances under Part II of the Army Pensions Act, 1953 (No. 23 of 1953), be in the Form A.P. 56A in the Schedule hereto,"

(3) by the substitution in the Form A.P. 57 set out in the Schedule, for paragraphs (a), (b) and (c) of the portion of that Form which refers to subsistence allowance of the following :

" Subsistence Allowance :

(a) Where the period of necessary absence from home is seven hours or more, and less than ten hours, Subsistence Allowance will be paid at the following rates :--

Witnesses, professional

4s.

0d.

Applicants and non-professional witnesses

3s.

6d.

(b) Where the period of necessary absence from home is ten hours or more, and less than twenty-four hours, Subsistence Allowance will be paid at the following rates :--

Witnesses, professional

8s.

10d.

Applicants and non-professional witnesses

5s.

6d.

(c) Where the period of necessary absence from home is twenty-four hours or more, Subsistence Allowance will be paid at the following rates for each completed period of twenty-four hours :--

Witnesses, professional

26s.

6d.

Applicants and non-professional witnesses

15s.

6d.

together with, in the case of any broken time (not being less than seven hours) over and above twenty-four hours or a multiple thereof, extra Subsistence Allowance for such broken time in accordance with whichever of the scales (a) and (b) is appropriate," and

(4) by the insertion in the Schedule, immediately after the Form A.P. 56 set out therein, of the following :

Register of Particulars of Service of Deceased Persons as certified by the Registration board in respect of whom Applications for Allowances have been made under Part II of th Army Pensions Act, 1953 .
