S.I. No. 158/1956:

ESTABLISHMENT ORDER (AERATED WATERS JOINT LABOUR COMMITTEE) AMENDMENT ORDER, 1956.

ESTABLISHMENT ORDER (AERATED WATERS JOINT LABOUR COMMITTEE) AMENDMENT ORDER, 1956.

WHEREAS the Aerated Waters Trade Board (hereinafter called " the Board ") was established by Regulations dated 1st March, 1933, made by the Minister for Industry and Commerce (S.R. & O. 1933 No. 45) (hereinafter called " the said Regulations ") for the trade specified in the Trade Boards (Aerated Waters) Order, 1919, (hereinafter called " the said Order ") and set out in the Schedule to the said Regulations :

AND WHEREAS the Board was a Trade Board which existed immediately before the Commencement of the Industrial Relations Act, 1946 , (hereinafter called " the Act ") and by virtue of Section 43 of the Act is deemed to be a Joint Labour Committee established under Part IV of the Act by an Establishment Order and operating in relation to the workers and employers in relation to whom it operated immediately before such commencement :

AND WHEREAS application has been made to the Labour Court (hereinafter called " the Court ") in accordance with Section 40 of the Industrial Relations Act, 1946 , by the Irish Transport and General Workers Union, for an Order varying the specification of the trade for which the Board was established and in which the employers and workers in relation to whom the Aerated Waters Joint Labour Committee operates are engaged :

AND WHEREAS the requirements of section 40 of the act have been complied with in respect of such application :

NOW THEREFORE the Court, in exercise of the powers conferred on it by Section 40 of the Industrial Relations Act, 1946 , hereby orders as follows :

(1) The said Order is hereby amended by the substitution for the appendix thereto of the First Schedule to this Order.

(2) The said Regulations are hereby amended by the substitution for the Schedule thereto of the First Schedule to this Order.

(3) The said regulations are hereby further amended by the substitution for Regulation 13 thereof of the Regulation set out in the Second Schedule to this Order.

(4) This Order shall come into operation on the 6th day of July, 1956.

(5) This Order may be cited as the Establishment Order (Aerated Waters Joint Labour Committee) Amendment Order, 1956.

FIRST SCHEDULE

THE AERATED WATERS AND WHOLESALE BOTTLING, TRADE, that is to say :--

(a) The manufacture, wherever carried on, of mineral or aerated waters, non-alcoholic cordials, flavoured syrups, unfermented sweet drinks, and other similar beverages, and the manufacture under licence of brewed liquors elsewhere than upon the licensed premises of a cider manufacturer or of a brewer of beer.

(b) the operations of bottle washing, bottling and filling, and all other operations preparatory to the sale of any of the aforesaid liquors in bottles, jars, syphons, casks or other similar receptacles,

(c) the operations of bottle-washing, bottling and filling and all subsidiary operations preparatory to the sale under a Beer Dealer's licence in bottles, jars or other similar receptacles of ale, stout, porter and other alcoholic beers except where such operations are conducted or carried on upon the licensed premises of a brewer of beer, and

(d) the operations of bottle-washing, bottling and filling, and all subsidiary operations preparatory to the sale by wholesale of cider in bottles, jars or other similar receptacles, except where such operations are conducted or carried on upon the licensed premises of a cider manufacturer.

SECOND SCHEDULE

The Joint Labour Committee may be known under the short title of " The Aerated Waters and Wholesale Bottling Joint Labour Committee."

EXPLANATORY NOTE

This instrument extends the scope of the Aerated Waters Joint Labour Committee by the inclusion, with specified exceptions, of the wholesale bottling of beers and cider whether carried on in association with the Aerated Waters trade or not. The title of the Committee has been amended accordingly.
