S.I. No. 217/1959:

ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1959.

ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1959.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 12 of the Roads Act, 1920 as applied by section 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) hereby makes the following Regulations :--

1. These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1959.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to these Regulations.

3. The Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) shall be amended as follows :--

(a) by the substitution for article 15 of the following article :--

" 15.(1)Before issuing a licence, a licensing authority may require the owner of a vehicle to furnish a declaration in the scheduled form as to the weight unladen of the vehicle for the purposes of the Act of 1952 and may, on giving at least seven days' notice in writing, require the owner of a vehicle to bring the vehicle to an appointed weighbridge at a specified time and forthwith to cause the vehicle to be weighed in the presence of an officer of the licensing authority in such condition and together with such additions as are required to be taken into account in the determination of its unladen weight for the assessment of the duty to which it is liable.

(2) In this article, any reference to a vehicle shall be construed as including a reference to a vehicle and another vehicle or an attachment which are, for the purposes of the Act of 1952, to be deemed to form and be a single vehicle."

(b) by the substitution in the second Schedule of " Form R.F.12/9--Declaration of unladen weight of vehicle ", for " Form R.F. 12/9 --Certificate of unladen weight of vehicle."

EXPLANATORY NOTE.

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ). The substantial amendment relates to the power of a licensing authority to require information as to the unladen weight of a vehicle for licensing purposes and is required consequential on the introduction of a new statutory definition of unladen weight.
