BOVINE TUBERCULOSIS (GENERAL PROVISIONS) (AMENDMENT) ORDER, 1960.

BOVINE TUBERCULOSIS (GENERAL PROVISIONS) (AMENDMENT) ORDER, 1960.

I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis, do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), order as follows:

Short title, collective citation and commencement.

1.--(1) This Order may be cited as the Bovine Tuberculosis (General Provisions) (Amendment) Order, 1960.

(2) The Principal Order and this Order may be cited together as the Bovine Tuberculosis (General Provisions) Orders, 1957 and 1960.

(3) This Order shall come into operation on the 4th day of July, 1960.

Principal Order

2. In this Order "the Principal Order" means the Bovine Tuberculosis (General Provisions) Order, 1957 ( S.I. No. 219 of 1957 ).

3. Article 3 of the Principal Order is hereby amended by the addition thereto of the following paragraph:

" (5) (a) Where a bovine animal gives a positive reaction to a test--

(i) the veterinary surgeon who carried out the test shall, immediately on completion thereof, remove from the animal any ear-tag which has been inserted in relation to any test previously carried out pursuant to the Act or any Order made thereunder or pursuant to the Bovine Tuberculosis Eradication Scheme and shall then mark the animal by punching a diamond-shaped hole of five-eights of an inch side in the left ear of the animal,

(ii) the owner or person in charge of the animal shall permit the veterinary surgeon to remove any such ear-tag and so to mark the animal.

(b) In this paragraph ' Bovine Tuberculosis Eradication Scheme ' means the scheme for the eradication of bovine tuberculosis which was initiated by the Minister in September, 1954.

EXPLANATORY NOTE.

This Order provides that, from 4th July, 1960, cattle of all types which give a positive reaction to a comparative test with avian and mammalian tuberculins must, immediately on completion of the test, be marked by the veterinary surgeon by means of a diamond-shaped hole of five-eighth inch side in the animal's left ear. In addition any ear-tags in relation to a tuberculin test must be removed from the animal.
