MENTAL HOSPITALS (OFFICERS AND SERVANTS) ORDER, 1946 (AMENDMENT) ORDER, 1960. |

The Minister for Health, being the appropriate Minister for the purposes of Part II of the Local Government Act, 1941 (No. 23 of 1941) as respects the offices to which this Order relates, in exercise of the powers conferred on him by sections 11 , 13 and 20 of the Local Government Act, 1941 as adapted by the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S. R. and O. 1947 No. 58) hereby orders and declares as follows:-- |

1. This Order may be cited as the Mental Hospitals (Officers and Servants) Order, 1946 (Amendment) Order, 1960. |
||
2. In this Order "the Principal Order" means the Mental Hospitals (Officers and Servants) Order, 1946 (S. R. and O. 1946 No. 203) |
||
3. Sub-article (1) of article 2 of the Principal Order is hereby amended by the insertion therein before the definition of "patient" of the following definition:-- |
||
"health authority" means a health authority within the meaning of the Health Act, 1947 , in their capacity as an authority performing functions under the Mental Treatment Acts, 1945 to 1958, or a joint board performing functions under those Acts. |
||
4. Articles 3, 5, 6 and 8 of the Principal Order are hereby revoked. |
||
5. Article 4 of the Principal Order is hereby amended by the deletion of the words "temporary attendants (male or female) or servants" and by the substitution therefor of the words "nursing attendants (male or female)". |
||
6. Articles 18 and 19 of the Principal Order are hereby amended by the insertion after each reference therein to the chief clerk of the words "or such other officer as may be nominated by the health authority". |

EXPLANATORY NOTE. |
||
The Order amends certain articles of the Mental Hospitals (Officers and Servants) Order, 1946. |
||
The amendments are necessary or desirable as the result of reorganisation of the staffing structure which has taken place or is contemplated in certain district mental hospitals following the enactment of the Health Authorities Act, 1960 . |
||
