SOCIAL WELFARE (OVERLAPPING BENEFITS) (AMENDMENT) REGULATIONS, 1961.

SOCIAL WELFARE (OVERLAPPING BENEFITS) (AMENDMENT) REGULATIONS, 1961.

I, SEÁN MacENTEE, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 and 32 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following regulations:--

1.--(1) These Regulations may be cited as the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1961.

(2) These Regulations and the Social Welfare (Overlapping Benefits) Regulations, 1953 to 1960, may be cited collectively as the Social Welfare (Overlapping Benefits) Regulations, 1953 to 1961.

2. These Regulations shall come into operation on the 4th day of August, 1961.

3. In these Regulations "the Principal Regulations" means the Social Welfare (Overlapping Benefits) Regulations, 1953 ( S.I. No. 14 of 1953 ).

4. Sub-article (4) of article 4 of the Principal Regulations as amended by article 4 of the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1960 ( S.I. No. 163 of 1960 ) and by article 6 of the Social Welfare (Overlapping Benefits) (Amendment) (No. 2) Regulations, 1960 ( S.I. No. 278 of 1960 ) is hereby further amended by the substitution--

(a) in paragraphs (a), (c), and (d) for the words "nine" and "seventeen", where they occur, of the words "ten" and "nineteen" respectively;

(b) in paragraph (b) for the words "seventeen" and "eight shillings and sixpence" of the words "nineteen" and "nine shillings and sixpence" respectively.

5. Article 5 of the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1960 as amended by article 7 of the Social Welfare (Overlapping Benefits) (Amendment) (No. 2) Regulations 1960, is hereby further amended by the substitution for the words "three shillings and sixpence" of the words "five shillings".

6. Sub-article (5) of article 4 of the Principal Regulations as amended by the Social Welfare (Overlapping Benefits) (Amendment) (No. 2) Regulations, 1960, is hereby further amended by the substitution for the words "forty-three shillings and threepence", "fifty-three shillings and threepence", and "sixty-three shillings and threepence" of the words "forty-four shillings and ninepence","fifty-four shillings and ninepence", and "sixty-four shillings and ninepence" respectively.

EXPLANATORY NOTE.

The Social Welfare (Miscellaneous Provisions) Act, 1961 , makes provision for increases in the rates of widows' (non-contributory) pensions. These Regulations provide for consequential increases in the limits prescribed in the Social Welfare (Overlapping Benefits) Regulations, 1953 ( S.I. No. 14 of 1953 ), as amended, to the combined rate payable by way of pension and disability benefit or unemployment benefit to a widow who is in receipt of a widow's (non-contributory) pension which is reduced in respect of means. The Regulations also make consequential adjustments in the allocations in respect of children.
