DENTAL AND AURAL APPLIANCES REGULATIONS, 1961.

DENTAL AND AURAL APPLIANCES REGULATIONS, 1961.

The Minister for Health, in exercise of the powers conferred on him by section 22 of the Health Act, 1953 (No. 26 of 1953), as amended by section 2 of the Health Act, 1954 (No. 23 of 1954) hereby makes the following Regulations:

1. These Regulations may be cited as the Dental and Aural Appliances Regulations, 1961.

2. In these Regulations--

"the Act" means the Health Act, 1953 (No. 26 of 1953);

"the Minister" means the Minister for Health.

3. Dental appliances shall be made available by a health authority under section 14 of the Act to the extent to which such appliances can be so made available by the expenditure in any local financial year of such sum as may be determined by the Minister, after consultation with the health authority.

4. In making available the service under section 14 of the Act for the provision of dental appliances, a health authority shall have particular regard to the needs of expectant and nursing mothers and persons certified by a registered medical practitioner to be suffering from tuberculosis.

5. A health authority may, in lieu of making a dental appliance available to a person under section 14 of the Act in the manner prescribed by article 8 of the General Medical Services Regulations, 1954 ( S.I. No. 102 of 1954 ), make, in accordance with an arrangement approved by the Minister, a payment towards the amount of any contribution made or to be made by that person to obtain a dental appliance under any other service or scheme.

6. Aural appliances shall be made available by a health authority under section 14 of the Act to the extent to which such appliances can be so made available by the expenditure in any local financial year of such sum as may be determined by the Minister, after consultation with the health authority.

7. In making available the service under section 14 of the Act for the provision of aural appliances, a health authority shall have particular regard to the needs of children, persons accustomed to the use of aural appliances whose appliances have become defective, persons dependent on an aural appliance to earn their livelihood, mothers with the care of young children, and persons who are both deaf and blind.

8. A health authority may make it a condition of the making available of an aural appliance to a person under section 14 of the Act that the person shall accept such instruction in the use of the appliance as may be determined by the health authority and shall observe such conditions in relation to the use and care of the aural appliance as may be specified by the health authority.

9. A health authority may, in lieu of making an aural appliance available to a person under section 14 of the Act in the manner prescribed by article 8 of the General Medical Services Regulations, 1954, make, in accordance with an arrangement approved by the Minister, a payment towards the amount of any contribution made or to be made by that person to obtain an aural appliance under any other service or scheme.

EXPLANATORY NOTE.

These Regulations will specify the extent (by relation to expenditure) to which health authorities will be obliged to make dental and aural appliances available under section 14 of the Health Act, 1953 , for persons in the lower income group. The Regulations also specify groups whose needs must be specially considered by a health authority in providing such appliances and provide that health authorities may contribute towards the cost of such appliances where obtained under another service or scheme.
