I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis and being satisfied that bovine tuberculosis is virtually non-existent in such area as consists of the administrative counties of Offaly and Westmeath (exclusive of those parts of the administrative county of Westmeath lying west of the River Shannon and west of the River Inny), do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), as amended by section 5 of the Diseases of Animals Act, 1960 (No. 26 of 1960), order as follows : |

1. (1) This Order may be cited as the Bovine Tuberculosis (Attested Area) (Amendment) (No. 6) Order, 1962. |
||
(2) This Order shall come into operation on the 13th day of October, 1962. |
||
2. In this Order " The Principal Order " means the Bovine Tuberculosis (Attested Area) Order, 1960 ( S.I. No. 236 of 1960 ). |
||
3. Article 2 of the Principal Order is hereby amended by the insertion, after the definition of " the Principal Act ", of the following : |
||
" ' Bovine Tuberculosis Eradication Scheme ' means the scheme for the eradication of bovine tuberculosis which was initiated by the Minister in September, 1954." |
||
4. (1) Article 3 of the Principal Order, as amended by the Orders specified in the next paragraph, is hereby further amended by the insertion after " west of the River Inny " of " and the administrative county of Offaly and the remaining part of the administrative county of Westmeath ". |
||
(2) The Orders referred to in the foregoing paragraph are the Bovine Tuberculosis (Attested Area) (Amendment) Order, 1961 ( S.I. No. 9 of 1961 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 2) Order, 1961 ( S.I. No. 17 of 1961 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 3) Order, 1961 ( S.I. No. 29 of 1961 ) and the Bovine Tuberculosis (Attested Area) (Amendment) (No. 4) Order, 1961 ( S.I. No. 156 of 1961 ). |

5. The Bovine Tuberculosis (Clearance Area) Order, 1961 ( S.I. No. 38 of 1961 ) and the Bovine Tuberculosis (Clearance Area) (Special Controls) Order, 1962 ( S.I. No. 87 of 1962 ) shall, in so far as they apply to the administrative counties of Offaly and Westmeath, cease to have effect. |

6. (1) The following subparagraph is hereby substituted for subparagraph (c) of paragraph (1) of Article 13 of the Principal Order : |
||
" (c) cattle which, during the period of 14 days ending immediately before the day of their entry into the area, have completed a test pursuant to the Bovine Tuberculosis (14-Day Test) Order, 1960 ( S.I. No. 176 of 1960 ), or a test under the Bovine Tuberculosis Eradication Scheme and have passed the test." |

(2) The following subparagraph is hereby substituted for subparagraph (c) of paragraph (2) of Article 15 of the Principal Order : |
||
" (c) cattle which, during the period of 14 days ending immediately before the day of their entry into the herd, have completed a test pursuant to the Bovine Tuberculosis (14-Day Test) Order, 1960 ( S.I. No. 176 of 1960 ), or a test under the Bovine Tuberculosis Eradication Scheme and have passed the test ". |

(3) The following subparagraph is hereby substituted for subparagraph (c) of paragraph (4) of Article 18 of the Principal Order : |
||
" (c) cattle which, during the period of 14 days ending at the material time, have completed a test pursuant to the Bovine Tuberculosis (14-Day Test) Order, 1960 ( S.I. No. 176 of 1960 ), or a test under the Bovine Tuberculosis Eradication Scheme and have passed the test." |
||
7. The following subparagraphs are hereby substituted, in each case, for subparagraphs (a) and (b) of paragraph (4) of Article 13, subparagraphs (a), (b) and (c) of paragraph (5) of Article 15 and subparagraphs (a), (b) and (c) of paragraph (3) of Article 19 of the Principal Order-- |

" (a) where the test was completed pursuant to the Bovine Tuberculosis (14-Day Test) Order, 1960, a tuberculin test certificate (export) or a tuberculin test certificate (domestic) issued under that Order, or a market clearance certificate in respect of the cattle; |
||
(b) where the test was completed under the Bovine Tuberculosis Eradication Scheme, a certificate issued by the veterinary surgeon who carried out the test." |
||
8. The following subparagraph is hereby inserted after subparagraph (d) of paragraph (1) of Article 13 of the Principal Order-- |
||
" (e) cattle being moved through the area to destinations within the administrative county of Dublin or the county borough of Dublin without being unloaded or sold or otherwise disposed of except at the said destinations." |

EXPLANATORY NOTE |
||
This Order, by extending the provisions of the Bovine Tuberculosis (Attested Area) Order, 1960, as amended, declares the administrative counties of Offaly and Westmeath (exclusive of those parts of the administrative county of Westmeath lying west of the River Shannon and west of the River Inny) to be an Attested Area, i.e., an area in which the Minister is satisfied that bovine tuberculosis is virtually non-existent, with effect from 13th October, 1962. It also (1) prohibits the tuberculin testing of cattle in the area, except with the permission of the Minister, (2) prohibits the movement of cattle into the area, except under permit, and specifies the classes of cattle for which such permits shall be granted, (3) regulates the movement of cattle into and out of herds in the area, (4) controls public sales of cattle in the area, (5) requires, in certain circumstances, the surrender to the Department of identity cards and ear-tags relating to cattle, and (6) provides for the disposal of reactors. |
