ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) REGULATIONS, 1964.

ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) REGULATIONS, 1964.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 82 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:--

1. These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Amendment) Regulations, 1964.

2. The Road Traffic (Public Service Vehicles) Regulations, 1963 ( S.I. No. 191 of 1963 ) and these Regulations shall be construed as one and may be cited together as the Road Traffic (Public Service Vehicles) Regulations, 1963 and 1964.

3. The Road Traffic (Public Service Vehicles) Regulations, 1963 are hereby amended by the substitution for sub-article (5) of article 62 of those Regulations of the following sub-article:--

"(5) The holder of a driving licence granted under Part III of the Road Traffic Act, 1933 (No. 11 of 1933) shall not drive a large public service vehicle while such vehicle is carrying passengers for reward unless he holds--

(a) a certificate of competency under paragraph (a) of subsection (2) of section 81 of the Road Traffic Act, 1933 ,

(b) a driver's licence which is expressed and which operates to license the holder to drive a public service vehicle of any kind, granted to him under section 104 of the Road Traffic Act, 1933 , or

(c) both a certificate of competency and a certificate of fitness in respect of vehicles of Class E under the Road Traffic (Licensing of Drivers) Regulations, 1964 ( S.I. No. 29 of 1964 )."

EXPLANATORY NOTE

These Regulations, which are of a transitional nature and are consequential on the coming into operation of the Road Traffic (Licensing of Drivers) Regulations, 1964, set out the conditions under which persons who hold unexpired driving licences under the Road Traffic Act, 1933 , may drive large public service vehicles.
