SOCIAL WELFARE (ABSENCE FROM THE STATE) (AMENDMENT) REGULATIONS, 1965.

I, CAOIMHGHÍN Ó BEOLÁIN, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 , 13 and 31 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following Regulations:--

1.--(1) These Regulations may be cited as the Social Welfare (Absence from the State) (Amendment) Regulations, 1965.

(2) The Social Welfare (Absence from the State) Regulations, 1953 and 1960, and these Regulations shall be construed as one and may be cited collectively as the Social Welfare (Absence from the State) Regulations, 1953 to 1965.

2. In the application of the Act in the case of persons who are outside the State in Northern Ireland, Great Britain or the Isle of Man, the definition of " qualified child " in subsection (1) of section 2 of the Act shall, for the purpose of an increase of old age (contributory) pension under subsection (1) of section 27 of the Act, as amended by section 8 of the Social Welfare (Miscellaneous Provisions) Act, 1964 (No. 28 of 1964), be modified by the deletion of " (b) is ordinarily resident in the State.".

3. Article 4 of the Social Welfare (Absence from the State) Regulations, 1953 ( S.I. No. 17 of 1953 ) as amended by the Social Welfare (Absence from the State) (Amendment) Regulations, 1960 ( S.I. No. 222 of 1960 ) is hereby further amended by the deletion in paragraph (c) of sub-article (1) of the words in brackets after the words " old age (contributory) pension " and the substitution therefor of the words " (including an increase under subsection (1) of section 27 of the Act or benefit under subsection (3) (inserted by section 8 of the Act of 1960) of section 26 of the Act)."

EXPLANATORY NOTE.

These regulations amend the Social Welfare (Absence from the State) Regulations, 1953 and 1960, by providing, for the purposes of old age (contributory) pension, that a child who is living in Northern Ireland, Great Britain or the Isle of Man may be regarded as ordinarily resident in the State.

The regulations also provide for the payment in Northern Ireland, Great Britain and the Isle of Man of increases of old age (contributory) pension in respect of children.
