MERCHANT SHIPPING (CARGO SHIP SURVEY FEES) ORDER, 1967.

I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by section 5 of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952), section 3 of the Merchant Shipping Act, 1966 (No. 20 of 1966), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and with the consent of the Minister for Finance, hereby make the following order:--

1. This Order may be cited as the Merchant Shipping (Cargo Ship Survey Fees) Order, 1967, and shall come into operation on the 15th day of June, 1967.

2. In this Order--

"certifying authority" means the Minister or other person authorised by the Minister to issue a cargo ship safety construction certificate;

"surveyor of ships" means a surveyor appointed by a certifying authority;

"tons" means gross tons.

3. Subject to paragraph 1 of the Schedule to this Order there shall be paid for the surveys mentioned in that Schedule the fees therein specified.

SCHEDULE.

1. Subject to paragraphs 2, 3 and 4 of this Schedule fees in accordance with the following Table of Fees shall be paid for surveys carried out in accordance with the Merchant Shipping (Cargo Ship Construction and Survey) Rules, 1967 ( S.I. No. 99 of 1967 ):--

2. Where a surveyor appointed by a certifying authority other than the Minister carries out concurrently with a survey for classification purposes a survey before the issue or renewal of a Cargo Ship Safety Construction Certificate or an intermediate survey no fees shall be payable under the preceding paragraph.

3. Where a surveyor of ships carries out a survey before the issue of a Cargo Ship Safety Construction Certificate on a ship the keel of which was laid before the 14th May, 1967, the fee payable on such survey shall be four times the amount shown in column (3) of the Table of Fees in paragraph 1 of this Schedule.

4. Where a surveyor of ships carries out a survey before the renewal of a Cargo Ship Safety Construction Certificate or an intermediate survey and such a survey is not completed in one operation but is effected by two or more partial surveys there shall be paid, in addition to the fees payable under column (3) or column (4), as the case may be, of the Table of Fees in paragraph 1 of this Schedule: --

(a) a fee of £20 for every partial survey, and

(b) a further fee of £20 for every additional visit when more than one visit is paid to the ship by the surveyor for the purposes of such a partial survey.

EXPLANATORY NOTE.

These Regulations prescribe the fees to be paid for the survey of the hull, equipment and machinery of seagoing cargo ships of not less than five hundred tons gross carried out in accordance with the Merchant Shipping (Cargo Ship Construction and Survey) Rules, 1967.
