FOOT AND MOUTH DISEASE (IMPORTATION OF ANIMALS) (AMENDMENT) ORDER, 1967. |

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 , 30 and 48 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows: |
||
1. (1) This Order may be cited as the Foot and Mouth Disease (Importation of Animals) (Amendment) Order, 1967. |
||
(2) This Order shall come into operation on the 13th day of December, 1967. |
||
2. The Foot and Mouth Disease (Importation of Animals) Order, 1967 ( S.I. No. 235 of 1967 ) shall be construed and have effect as if-- |
||
(a) the following Article were inserted therein after Article 3: |
||
"3A. The import from Northern Ireland of any cattle, sheep or swine is hereby prohibited unless the cattle, sheep or swine, as the case may be, are imported under and in accordance with a licence granted in that behalf by the Minister for Agriculture and Fisheries and the person for the time being in charge of the animals to which such licence relates shall, if requested, deliver the licence to an officer of Customs and Exercise.", |

(b) the following Articles were inserted therein after Article 5: |
||
"6. Subject to Articles 3 and 3A, in case a licence has been granted for the purposes of this Order by the Minister for Agriculture and Fisheries, the person for the time being in charge of an animal to which the licence relates shall have the licence in his possession. |
||
7. Subject to Article 10, in case a condition attached to a licence granted for the purposes of this Order specifies a place to which animals are to be moved, the animals to which the licence relates shall, save as may otherwise be provided by the condition, forthwith be moved directly to that place and shall, while in transit thereto, neither be detained nor be allowed to mix with other animals. |

8. A person having in his possession pursuant to this Order a licence shall, on demand made by a member of the Gárda Síochana or an inspector of the Minister for Agriculture and Fisheries or a person appointed by the said Minister in writing to be an authorised officer for the purposes of this Order produce it for inspection by such member, inspector or person. |
||
9. In case the Minister for Agriculture and Fisheries attaches a condition to a licence granted for the purposes of this Order, the person who is in charge of an animal to which the licence relates shall comply with the condition and any failure by such person, whether by act or omission, to comply with any such condition is hereby declared to be an offence. |
||
10. Nothing in this Order shall be construed as affecting the operation of, (i) any Order made under section 28 (b) or section 29 (b) of the Diseases of Animals Act, 1966 (No. 6 of 1966), or (ii) any instrument being an instrument mentioned in section 9 (3) or section 10 of the said Act and made under provisions of the Diseases of Animals Acts, 1894 to 1960, corresponding to the said sections 28 (b) or 29 (b)". |

EXPLANATORY NOTE. |
||
This Order extends the provisions of the Foot and Mouth Disease (Importation of Animals) Order, 1967 ( S.I. No. 235 of 1967 .) to cattle, sheep and swine imported from Northern Ireland. On and after the 13th December, 1967, the importation from that area of animals coming under any of these categories is prohibited except under licence. |
